Regulations on land use for urban and rural residential area improvement
Mr. Pham Van Binh in Vinh City asked: How is the use of land for urban and rural residential area renovation regulated in the new Land Law? Are organizations and individuals allowed to contribute land use rights to build and renovate works serving the common interests of the community?
Reply:
Article 198, Land Law 2024 stipulates on theland use for urban and rural residential areasas follows:
1. Land used for urban beautification includes land for beautification of existing inner-city areas and land planned for urban expansion.
Land used for rural residential area improvement includes land for improvement in existing residential areas, land belonging to the agricultural land fund used for public purposes, and land planned for rural residential area expansion.

2. The use of land for urban and rural residential area improvement must comply with the planning, land use plan, construction plan approved by competent authorities and construction standards and regulations issued by competent state agencies.
3. The State shall reclaim land, allocate land, and lease land to implement urban and rural residential area improvement projects in the cases specified in Article 79 of this Law.

4. Organizations and individuals are allowed to contribute land use rights to build and renovate works serving the common interests of the community using capital contributed by the people or supported by the State.
Voluntary contribution of land use rights, compensation or support shall be agreed upon by the organization or individual. Contribution of land use rights and land readjustment shall be carried out in accordance with the provisions of Article 219 of this Law.
