Regulations concerning cemetery land, funeral homes, and crematoriums.
Mr. Nguyen Van Binh, residing in Yen Thanh district, asks: What are the regulations regarding land for cemeteries, funeral homes, and crematoriums in the 2024 Land Law?
Reply:
Article 214 of the 2024 Land Law stipulates the following regarding land for cemeteries, funeral homes, crematoriums; and land for facilities storing cremated remains:
1. Land for cemeteries, funeral homes, crematoriums; and land for facilities storing cremated remains must be planned as concentrated areas, in accordance with land use planning and construction planning, ensuring hygiene, environmental protection, and land conservation.
2. It is strictly prohibited to establish cemeteries, funeral homes, crematoriums, or ash storage facilities that are contrary to the land use plan and construction plan approved by the competent authority.

3. Land for cemeteries, funeral homes, crematoriums, and ash storage facilities is allocated or leased by the State to economic organizations according to the following regulations:
a) Granting land with land use fees for the construction of crematorium facilities, for the implementation of cemetery infrastructure investment projects, and for the transfer of land use rights associated with crematorium storage infrastructure;
b) Leasing land for the construction of funeral homes and crematoriums.
4. Land for cemeteries, funeral homes, crematoriums, and ash storage facilities that do not fall under the cases specified in Clause 3 of this Article shall be assigned by the State to the People's Committee of the commune or a public service unit for management.
