Regulations on land for cemeteries, funeral homes, and crematoriums
Mr. Nguyen Van Binh, residing in Yen Thanh district, asked: What does the 2024 Land Law stipulate about land for cemeteries, funeral homes, and crematoriums?
Reply:
Article 214 of the 2024 Land Law stipulates land for cemeteries, funeral homes, crematoriums; and land for facilities storing ashes as follows:
1. Land for cemeteries, funeral homes, crematoriums, and facilities for storing ashes must be planned into concentrated areas, in accordance with land use planning, construction planning, hygienic, environmentally friendly, and land-saving.
2. It is strictly forbidden to establish cemeteries, funeral homes, crematoriums, and ash storage facilities contrary to the planning, land use plans, and construction plans approved by competent authorities.

3. The State shall allocate or lease land for cemeteries, funeral homes, crematoriums, and ash storage facilities to economic organizations according to the following provisions:
a) Land allocation with land use fee collection to build facilities to store ash, to implement cemetery infrastructure investment projects to transfer land use rights associated with infrastructure to store ash;
b) Land lease for construction of funeral homes and crematoriums.
4. Land for cemeteries, funeral homes, crematoriums, and ash storage facilities that do not fall under the provisions of Clause 3 of this Article shall be assigned by the State to the People's Committees at the commune level or public service units for management.
