Regulations on land use for airports and civil airfields.

Article 208The 2024 Land Law stipulates the land use for airports and civil airfields.as follows:

1. Land used for airports and civil airfields includes:

a) Land for constructing headquarters of state agencies and units of the people's armed forces at airports, land for constructing airport infrastructure and other auxiliary facilities and areas of airports owned by the State;

b) Land for constructing infrastructure facilities of the airport and aviation and non-aviation service facilities other than those specified in point a of this clause.

2. Based on the land use planning and civil airport planning approved by the competent authority, the Provincial People's Committee shall allocate and lease land according to the following regulations:

a) Land shall be allocated without collecting land use fees for land specified in point a, clause 1 of this Article;

b) Leasing land and collecting annual land rent for land specified in point b, clause 1 of this Article;

c) The remaining area after land allocation or land lease as stipulated in points a and b of this clause shall be handed over to the Airport Authority of that airport for management.

3. The provincial People's Committee is responsible for allocating land and assigning land to the People's Public Security forces to ensure security and order in the area of ​​civil airports and airfields.

4. In the case of civil airports and airfields implemented under a public-private partnership investment project involving land use, the provisions of Article 207 of this Law shall apply.

5. The Government shall provide detailed regulations for this Article.
