Regulations on adjusting the land use term of investment projects
Mr. HMD from Vinh City asks: How are the regulations regarding the adjustment of land use duration for investment projects stipulated?
Article 175 of the 2024 Land Law stipulates the conditions for adjusting the land use term of investment projects as follows:
1. Adjusting the land use term for investment projects using land before the land use term expires must meet the following conditions:
a) In accordance with the district-level land use plan;
b) There is a written request to adjust the land use term of the investment project;
c) Having fulfilled all financial obligations regarding land to the State as prescribed by law;
d) Not falling under the cases of land reclamation stipulated in Article 81 of this Law;
d) There is a document from a competent authority regarding the adjustment of the investment project in accordance with the law, which results in a change to the operating period of the investment project;
e) Meeting the environmental requirements as stipulated by the law on environmental protection.
2. The land use term of the project after adjustment shall not exceed the term stipulated in Point c, Clause 1, Article 172 of this Law.
