Regulations on the implementation of the Party Charter

Regulation No. 208-QD/TW stipulates the contents regarding the Party's organizational system; the principles of organization and organizational structure of the Party; Party members; Party organizations in the Vietnam People's Army and the Vietnam People's Public Security; inspection, supervision, commendation, and discipline; the Party's leadership of the State, the Fatherland Front, and political and social organizations; and the Party's finances.

According to Regulation No. 208-QD/TW (the Regulation), the Party's organizational system is organized at the commune level (including communes, wards, and special zones), provincial and city levels, and the central level.

This is the basic organizational system of the Party, functioning to provide comprehensive leadership at each level and for the entire Party. The establishment of Party organizations within Party and State agencies, the Fatherland Front, and political and social organizations includes: At the central level, Party committees of central Party agencies; the National Assembly Party committee; the Government Party committee; and Party committees of the Fatherland Front and central organizations directly under the Central Committee of the Party.

In provinces and cities (collectively referred to as provincial level), Party committees of provincial and city Party agencies and Party committees of provincial and city People's Committees shall be established under the provincial-level Party committee. Pilot programs shall be implemented to establish Party committees of provincial and city People's Councils and Party committees of the Fatherland Front and mass organizations under the provincial-level Party committee.

At the commune, ward, and special zone levels (collectively referred to as the commune level), the provincial Party committee decides on the establishment of the commune, ward, and special zone Party organizations as grassroots Party committees directly under the provincial Party committee. Party organizations in the Vietnam People's Army and the Vietnam People's Police are established according to the regulations of the Politburo. In areas with unique characteristics, Party committees of ministries and ministerial-level agencies establish grassroots Party committees in economic groups, corporations, and enterprises with important economic, social, national defense, and security positions.

The Party's organizational principles and structure, as outlined in the Regulations, specify several provisions regarding the implementation of the principle of democratic centralism. Regarding the working regulations of Party committees, the Politburo issued model working regulations for Party committees directly under the Central Committee. The Secretariat issued model working regulations for provincial and city Party committees, and for grassroots Party committees; Party committees directly under the Central Committee issued model working regulations for grassroots Party committees, departmental Party committees, and Party branches according to the guidance of the Central Organization Department.

Regarding the implementation of the principle of self-criticism and criticism, according to the Regulations, annually, the Politburo, the Secretariat, the standing committees of provincial-level Party committees, the standing committees of grassroots Party committees, Party committees directly under grassroots Party committees, departmental Party committees, Party branches, and inspection committees must conduct collective and individual self-criticism and criticism, review the exemplary responsibilities of cadres and Party members; and develop plans and measures to promote strengths and overcome limitations and shortcomings.

At the end of the Party Congress term, the Central Committee, the Politburo, the Secretariat, Party committees at all levels, standing committees of Party committees, Party branches, inspection committees, Party committee members at all levels, branch committee members, inspection committee members, and the collective leadership of specialized agencies advising and assisting the Central Committee and Party committees at all levels must conduct self-criticism and criticism in conjunction with reviewing and evaluating the results of implementing the Party Congress resolutions.

For Party members, the Regulations clearly stipulate the age and educational qualifications required for joining the Party. Regarding age, at the time the Party branch considers admission, the applicant must be between 18 and 60 years old (calculated by month); the admission of individuals over 60 years old is considered and decided by the Party committee directly under the Central Committee. Regarding educational qualifications, applicants must have completed at least lower secondary education; for applicants living in mountainous areas, islands, ethnic minority regions, or areas with particularly difficult socio-economic conditions, the general regulations may not be met, but the guidelines of the Party Secretariat will apply.

The regulations also specify several details regarding the Party's leadership of the State, the Fatherland Front, and political and social organizations. The Party uniformly leads personnel work and manages the cadre team, while simultaneously promoting the role and responsibility of organizations and their leaders within the political system in personnel matters.

The Party sets forth guidelines, policies, criteria, standards, regulations, and rules on personnel work and, through Party committees, Party organizations, and Party members in state agencies, the Fatherland Front, mass organizations, enterprises, and public service units, leads all levels and sectors in organizing the implementation of the Party's decisions on personnel and personnel work.

The head of the Party committee, Party organization, agency, or unit is responsible for proposing and organizing the implementation of collective decisions on personnel and personnel work in the field under their assigned responsibility.

The Central Committee of the Party assigns the Politburo and the Secretariat to lead and direct Party committees, Party organizations, and specialized agencies advising and assisting Party committees, cadres, and Party members to thoroughly understand and implement the Regulations on the Implementation of the Party Charter in conjunction with the restructuring of administrative units and the organizational apparatus of the political system; and to direct specialized agencies advising and assisting Party committees to conduct research to guide the implementation of digital transformation in the activities of Party organizations, agencies, and units, addressing issues related to methods, processes, procedures, and professional practices to concretize the provisions of the Party Charter, in accordance with the current situation and practical requirements of Party building work.

Regulation No. 208-QD/TW takes effect from the date of signing. All previous regulations contrary to the content of this Regulation are hereby repealed.
