Regulations regarding time limits when receiving land use rights transfers.
Mr. N.D.T from Tuong Duong district asks: According to the 2024 Land Law, what is the prescribed land use term when receiving land use rights through transfer?
Article 174 of the 2024 Land Law stipulates:
1. The land use term upon receiving the transfer of land use rights for land types with a specified term is the remaining land use term of the land use term before receiving the transfer of land use rights. Extension of land use rights shall be carried out in accordance with the provisions of Clause 3, Article 172 of this Law.
In cases where individuals directly engaged in agricultural production acquire the right to use agricultural land within the allocated land limit through land transfer or through mortgage agreements to settle debts, and after a court judgment, decision, or enforcement order has been executed and the land use period has expired, they may continue to use the land for the period stipulated in Article 172 of this Law without having to go through the renewal procedure.
2. The person who receives the transfer of land use rights for land designated for stable and long-term use is entitled to use the land stably and long-term.
