Regulations on land use term when changing purpose
Ms. NTT in Nghi Loc district asked: According to the 2024 Land Law, how is the land use term regulated when changing land use purpose?
Article 173 of the 2024 Land Law stipulates:
1. The land use term for individuals when changing land use purpose is stipulated as follows:
a) In case of converting special-use forest land or protective forest land to another type of land, the duration shall be determined according to the duration of the land type after the purpose of use is changed. The land use duration shall be calculated from the time of the decision permitting the change of land use purpose;
b) In case of converting annual crop land, perennial crop land, production forest land, aquaculture land, salt-making land to special-use forest land or protective forest land, the land use term is stable and long-term;
c) In case of changing the purpose of use between types of agricultural land not falling under the cases specified in Point a and Point b of this Clause, the individual using the land may continue to use that land according to the allocated or leased term;
d) In case of converting agricultural land to non-agricultural land, the land use term is determined according to the term of the land type after the purpose of use is changed. The land use term is calculated from the time of the decision allowing the change of land use purpose.

2. The land use term when changing the land use purpose to implement an investment project is determined according to the provisions at Point c, Clause 1, Article 172 of this Law, except for the case specified in Clause 3 of this Article.
3. The land use term in the case of changing the purpose of use from non-agricultural land used stably and permanently to non-agricultural land used for a limited period or from non-agricultural land used for a limited period to non-agricultural land used stably and permanently is stable and permanent.
