Regulations regarding the land use duration when changing land use purposes.
Ms. NTT from Nghi Loc district asks: According to the 2024 Land Law, what is the prescribed land use term when changing the land use purpose?
Article 173 of the 2024 Land Law stipulates:
1. The land use term for individuals when changing the land use purpose is stipulated as follows:
a) In the case of converting special-use forest land or protection forest land to another type of land, the term shall be determined according to the term of the land type after the conversion of land use purpose. The land use term shall be calculated from the date of the decision permitting the conversion of land use purpose;
b) In the case of converting land used for annual crops, perennial crops, production forests, aquaculture, or salt production to special-use forests or protection forests, the land use period shall be long-term and stable;
c) In cases of conversion of land use between different types of agricultural land not covered by points a and b of this clause, the individual land user may continue to use the land for the term for which it was allocated or leased;
d) In the case of converting agricultural land to non-agricultural land, the land use term shall be determined according to the term of the land type after the conversion. The land use term shall be calculated from the date of the decision permitting the land use conversion.

2. The land use term when changing the land use purpose for the implementation of an investment project shall be determined according to the provisions of point c, clause 1, Article 172 of this Law, except for the cases specified in clause 3 of this Article.
3. The land use term for cases of conversion from non-agricultural land with long-term stable use to non-agricultural land with limited use term, or from non-agricultural land with limited use term to non-agricultural land with long-term stable use, is long-term stable use.
