Reply:Article 188Land Law 2024regulations regarding DAll bodies of water are ponds, lakes, and swamps.as follows:
1. Land with water surface, such as ponds, lakes, and swamps, is allocated by the State to individuals within a specified limit for use in aquaculture and agricultural production.
Land with water surfaces such as ponds, lakes, and swamps is leased by the State to economic organizations, individuals, people of Vietnamese origin residing abroad, and economic organizations with foreign investment capital to implement investment projects in aquaculture, agricultural production, or agriculture combined with non-agricultural purposes.
Land use must ensure the preservation of the landscape, protect the environment, and conserve water resources.

2. For land with surface water such as lakes and ponds located in the territory of multiple communes, wards, and towns, the use shall be decided by the People's Committee of the district level. For lakes and ponds located in the territory of multiple districts, counties, towns, cities within provinces, or cities within centrally-governed cities, the use shall be decided by the People's Committee of the province level.
3. Economic organizations, individuals, people of Vietnamese origin residing abroad, and economic organizations with foreign investment capital that are allocated or leased land by the State for leveling or digging lakes and ponds to create spaces for water collection and storage, or to create landscapes, must obtain permission from the competent state agency and must conduct an environmental impact assessment in accordance with the law on environmental protection.
