What are the rights and obligations of local communities using land under the 2024 Land Law?
I would like to know more about the regulations regarding the rights and obligations of local communities using land, as stipulated in the latest law. This is a question from Mr. Dang Thanh Hao (Nghi Loc, Nghe An).
Reply:A community is a group of people living in the same area, such as a hamlet, village, or similar residential area within the territory of the Socialist Republic of Vietnam. According to Article 39 of the 2024 Land Law, the rights and obligations of communities using land are stipulated as follows:
1. The community using the land has common rights and obligations as stipulated in Articles 26 and 31 of this Law.
2. The community using the land has the same rights and obligations as individuals with corresponding land use rights, except for the right to inheritance.
In cases where a community is allocated land by the State without payment of land use fees, or whose land use rights are recognized through land allocation without payment of land use fees, they do not have the right to convert, transfer, donate, lease, mortgage, or contribute land use rights as capital.
