The Ho Chi Minh City People's Court has just notified Ms. Nguyen Thi Thanh Huyen (32 years old, residing in Khanh Hoa province) that the decision to recognize and enforce the judgment of the French court in Vietnam, which was declared by this court, has been appealed in its entirety by Mr. Step'phane Azais (a French businessman, Huyen's boyfriend).
Previously, on May 31, the Ho Chi Minh City People's Court issued a decision to recognize the entire judgment of the French court and enforce that judgment in Vietnam regarding the settlement of the child custody dispute between Ms. Huyen and her boyfriend.
According to the decision, Huyen and Mr. Stephane Azais had a relationship before 2013 but then had conflicts leading to their separation. In 2014, Huyen gave birth to baby Thien Kim and was granted a birth certificate by the French diplomatic agency.
However, after Thien Kim was 3 months old, Mr. Azais took the baby away (to France), making it impossible for Huyen to see her child.
Ms. Huyen went all the way to France to sue Mr. Azais. In June 2016, the Albi court of wide jurisdiction ruled that Mr. Azais must immediately hand over baby Thien Kim to Huyen.
However, immediately after the verdict was announced, Mr. Azais took baby Thien Kim back to Vietnam, preventing Ms. Huyen from seeing her child.
Therefore, Ms. Huyen submitted a petition requesting the Ho Chi Minh City People's Court to issue a decision to recognize the entire above judgment in Vietnam and enforce this judgment.
According to the verdict, Huyen will be cared for, raised and have her passport. Mr. Azais will be responsible for paying for her to attend an international school. At the same time, Mr. Azais has the right to visit Thien Kim.
