Driver of 'dump truck' that killed a mother and her two children receives sentence.
(Baonghean.vn) - Due to lack of observation, failure to control speed, and not maintaining a safe distance, driver Quan caused a serious accident resulting in the tragic deaths of a young mother and her two small children. At the trial, the defendant repeatedly apologized to the victim's family.
On August 22, the People's Court of Nghe An province opened a trial to hear the case against defendant Nguyen Duy Quan (37 years old), residing in Nghi Cong Nam commune, Nghi Loc district, for the crime of "Violating regulations on participation in road traffic."
Quân is a driver for a transportation company. At approximately 6:00 AM on March 6, 2023, Quân was driving a Howo truck carrying construction materials (stones) in the cargo bed, exceeding the permitted load limit by more than 30%, from the Bai Giang stone quarry (in Nghi Cong Nam commune) to Quan Hanh town, Nghi Loc district.
At 6:55 AM, upon reaching Km05+800m on Provincial Road 542E (in Hung Trung commune, Hung Nguyen district), they spotted a motorbike driven by Ms. Nguyen Thi H. (26 years old), carrying three young children, traveling ahead in the same direction on the right side of the road. At the same time, a truck was traveling in the opposite direction on the left side of the road.
Due to a lack of attention, failure to control speed, and not maintaining a safe distance, Quân caused the truck he was driving to collide with the motorbike driven by Ms. H. The motorbike and Ms. H. and her four children were dragged under the truck. After causing the accident, Quân drove the truck for more than 30 meters before finally stopping.
As a result, Ms. H. and her two young children, Hoang Van B. (9 years old) and Hoang Kim O. (7 years old), died on the spot due to multiple injuries. Hoang Van Tr. (5 years old) was injured and taken to the hospital for emergency treatment, with a 3% body injury rate.
At the trial, the defendant expressed remorse for his wrongdoing. The driver admitted that his lack of observation caused the serious accident. The defendant repeatedly apologized to the victim's family.
Following the incident, the defendant influenced his family and company to compensate the victim's family with nearly 640 million VND.
The panel of judges determined that in this case, the defendant committed an unintentional error due to negligence. The fact that the defendant surrendered, confessed honestly, showed remorse, and influenced his family to partially compensate the victim for emotional distress are mitigating circumstances that should be considered.
After considering all aspects of the case, the court sentenced Nguyen Duy Quan to 7 years and 6 months in prison. Regarding the civil aspect, the court ordered the company that hired Quan to compensate the victim's family 690 million VND (after deducting the amount already paid) and provide monthly child support of 1.8 million VND for the 5-year-old child until they reach 18 years old. Subsequently, according to the Civil Law, the defendant is responsible for reimbursing part or all of the compensation paid to the victim as agreed upon by both parties (the company and the defendant Quan).
