The Government Inspectorate, in coordination with the Ministry of Natural Resources and Environment, relevant ministries and agencies, and the People's Committees of provinces and centrally-administered cities, will plan and organize inspections of the management and use of land originating from state-owned agricultural and forestry farms.

Over 600 agricultural and forestry farms, with nearly 8 million hectares of land allocated to them, only contribute about 180 billion VND to the state budget each year.

This important content is mentioned in the directive on strengthening the management of land originating from state-owned farms and forestry enterprises used by agricultural companies, forestry companies, forest management boards, and other organizations, households, and individuals, which was recently signed and issued by the Prime Minister.

According to the directive, the Prime Minister also requested the Ministry of Agriculture and Rural Development and other relevant ministries and agencies to inspect and control the implementation of policies and laws on land management and use for land originating from state-owned agricultural and forestry farms.

Relevant ministries and agencies must propose solutions and develop a roadmap to fundamentally resolve land disputes by the end of 2016; address violations of the law, especially illegal encroachment, transfer, change of purpose, leasing, lending, and contracting of land, and failure to fulfill or delayed fulfillment of financial obligations.

Focus on promptly resolving all cases of unauthorized construction, housing, and illegal residence within land and forests managed by agricultural and forestry companies. Recover assets, land, and finances for the State in accordance with the law.

The Prime Minister assigned the People's Committees of provinces and centrally-administered cities the responsibility of directing relevant departments and agencies to organize the review, determination of boundaries, demarcation, surveying, preparation of cadastral maps and land use boundary records; carrying out procedures for land leasing, determining land prices, collecting land lease fees; and issuing land use right certificates in accordance with the law for agricultural and forestry companies undergoing restructuring under Decree No. 118/2014/ND-CP.

Simultaneously, develop and implement a plan to strengthen management of land originating from state-owned agricultural and forestry farms in the locality for the period 2016-2020; conduct inspections, audits, controls, dispute resolution, and handle violations of land laws related to land originating from state-owned agricultural and forestry farms. Receive and develop plans for the use of land funds transferred to the locality by agricultural and forestry companies and organizations converted from state-owned agricultural and forestry farms during the review and restructuring process.

The People's Committees of provinces and centrally-administered cities should proactively allocate local budgets to carry out land management tasks in their localities, ensuring that at least 10% of revenue from land use fees is invested in land surveying, cadastral mapping, registration, and issuance of land certificates; with priority given to land originating from state-owned agricultural and forestry farms.

Provinces need to ensure openness, transparency, and democracy, and prioritize policies for ethnic minorities, poor households and individuals residing in remote areas, border regions, and islands when implementing land policies and laws at the local level.

According to a report by the National Assembly's Finance and Budget Committee in late 2015, despite owning millions of hectares of land, state-owned agricultural and forestry farms only contribute about 180 billion VND to the state budget each year, less than the amount contributed by a typical factory.
