How long is a notice of land expropriation for national defense and security purposes valid under the new Land Law?

ReplyBased on Article 85 of the 2024 Land Law, the notification of land acquisition and compliance with land acquisition decisions for national defense and security purposes; and socio-economic development for national and public benefit are regulated as follows:

2. In cases where land users, owners of assets attached to the land, and persons with related rights and obligations in the land acquisition area agree to allow the competent State agency to acquire the land before the deadline stipulated in Clause 1 of this Article, the competent People's Committee shall decide on the land acquisition without waiting until the end of the deadline stipulated in Clause 1 of this Article.

3. Landowners whose land is being acquired and owners of assets attached to the land are responsible for cooperating with the units and organizations implementing compensation, support, and resettlement tasks during the investigation, survey, measurement, counting, and development of compensation, support, and resettlement plans.

4. Once the land expropriation decision takes effect and the compensation, support, and resettlement plan approved by the competent authority is publicly announced, the landowners, owners of assets attached to the land, and those with related rights and obligations must comply with the land expropriation decision.

5. The land expropriation notice is valid for 12 months from the date of issuance.

Therefore, the notice of land expropriation for national defense and security purposes is valid for 12 months from the date of issuance of the notice.
