I own a 120m² plot of land for which I received a land use certificate in 1995. Later, my family purchased an additional 30m² of land from a neighbor, with only a handwritten agreement and no official transfer of ownership. Currently, we are using this additional land without any disputes. What steps do I need to take to obtain a land title certificate for this additional land? In her case, the land plot already has a land title certificate, but the additional land purchased has not yet been registered under her name. According to the law, when the actual area of ​​land used differs from the area stated on the land title certificate, the land user must register the change in ownership.

Based on Decree 101/2024/ND-CP, if the additional land purchased has not been transferred to your name before the Decree takes effect, you have the right to apply for a Certificate of Land Use Rights for the entire area you are currently using, including the additional land you purchased. The Land Registration Office will also amend the seller's documents according to regulations.

The required documents include: a land registration change application form, the existing land title certificate, and documents proving the purchase of additional land. The application should be submitted to the Land Registration Office where the land is located or through the One-Stop Service Center, which will then forward it to the Land Registration Office for processing.

Therefore, after completing the procedures, she will be granted a land ownership certificate for the entire area she is currently using, ensuring the legitimate rights of her family.
