(Baonghean) - In recent times, despite facing many difficulties, the authorities have actively implemented various solutions to accelerate the issuance of land use right certificates; and at the same time, definitively resolve outstanding and problematic cases.
Speed up the process.
Nghia Hoi commune (Nghia Dan district) is one of the first units to participate in the process of issuing and exchanging land use right certificates. Mr. Cao Dai Thang, a land cadastral officer of Nghia Hoi commune, said: "The Land Law came into effect in 2013. After completing land consolidation and exchange, the relevant agencies coordinated with the commune People's Committee to carry out the issuance and exchange of land use right certificates based on digitized maps. To date, the commune has completed the issuance and exchange of land use right certificates for 1,850 out of 1,900 households, achieving over 96%."
Mr. Le Duc An, Head of the Department of Natural Resources and Environment of Nghia Dan district, said: Currently, the issuance of land use right certificates under the project in the district has been completed in 24 communes; of which 8 communes are currently submitting their applications to the Department of Natural Resources and Environment for inspection and acceptance: Nghia Binh, Nghia Phu, Nghia Loc, Nghia Mai, Nghia Duc, Nghia Lam, Nghia Hong, and Nghia Dan town.

In Tan Ky district, 956 land use right certificates were issued in 2016. Specifically, 449 new certificates were issued for residential land with an area of 25.92 hectares; 264 certificates for agricultural land with an area of 49.9 hectares; and 14 certificates for forestry land with an area of 43.15 hectares. 205 certificates were exchanged for residential land with an area of 30.98 hectares; and 24 certificates for agricultural land with an area of 8.98 hectares. Within the district, 16 communes have completed the surveying, declaration, and preparation of land use right certificate applications, while 6 communes and towns (Tan Ky town, and the communes of Tan Hop, Dong Van, Tan Long, Huong Son, and Tan Phu) are currently carrying out the surveying, declaration, and preparation of applications for land use right certificate exchanges with the support of a consulting unit.
For agricultural land, in 2016, the entire province issued 522,438 land use certificates covering an area of 208,534.28 hectares, reaching 89.53% of the total area requiring certification. 102,405 certificates were issued for forestry land, covering a total area of 238,518.52 hectares, reaching 79.79% of the total area requiring certification. For rural residential land, 572,652 certificates were issued, covering an area of 18,842.96 hectares, reaching 91.28%. For urban residential land, the entire province issued 109,665 certificates, covering an area of 2,605.12 hectares, reaching 93.68%.
Existing problems need to be addressed promptly.
Mr. Le Duc An, Head of the Department of Natural Resources and Environment of Nghia Dan District, added: Some households have not paid attention to the issuance of land use right certificates, failing to declare, register, or supplement documents, leading to a backlog of applications and affecting the review process. Some households and individuals in the communes have not fulfilled their financial obligations to the State regarding land when their applications have been reviewed and they have been notified to fulfill their financial obligations, and have not completed the procedures for recording land use fee debts. Many households and individuals use land in a manner inconsistent with the planning, encroaching on land, resulting in unresolved disputes. Applications for land use right certificates for forestry land are still pending because many land parcels do not conform to the planning according to Decision No. 48/2014/QD-UBND dated August 15, 2014, of the People's Committee of Nghe An Province on adjusting the planning of 3 types of forests.
In the coming period, the district will continue to direct and review the updating of complete land cadastral records for all cases that have been granted land certificates in recent years. For outstanding cases of land law violations, it is necessary to direct the declaration and registration process to create files for strict management of all cases; at the same time, a plan will be developed to gradually conduct inspections, audits, and definitively handle violations in accordance with land law regulations to rectify, strengthen, and improve the effectiveness of state land management in the locality.

The current challenge is that in some cases, land is in use and eligible for land use right certificates, but disputes arise during the application process, preventing resolution. For forest land, due to its large area, wide scope, and the difficulty in determining boundaries based on current land use, the land used by households and individuals overlaps with that of organizations. Furthermore, cadastral records used for issuing land use right certificates show significant changes compared to the current situation, requiring surveying and updating before certificates can be issued.
Currently, the Department of Natural Resources and Environment is coordinating with other sectors to strengthen the dissemination and promotion of the 2013 Land Law among the people. It is directing the People's Committees of communes to review the area of aquaculture land, 5% agricultural production land managed by the commune-level People's Committees, and the area of forestry land allocated to village communities and managed by the commune-level People's Committees, as well as individuals and entities using the land improperly, in order to develop plans to reallocate it to households facing land shortages for production or to create plans for leasing the land in accordance with regulations.
