Reply:Pursuant to Sub-section 6, Section B, Part II of the List of administrative procedures issued together with Decision No. 3380/QD-BTNMT dated June 28, 2025 of the Ministry of Natural Resources and Environment (effective from August 25, 2025), stipulating the procedure for "Registration of land, assets attached to land, issuance of Certificates of land use rights, ownership of assets attached to land for the first time for organizations using land".
Accordingly, the dossier includes:
Application for land registration and property attached to land.
Diagram or extract of cadastral map, land plot measurement extract (if any).
Report on reviewing current land use status according to Form No. 15d issued with Decree 151/2025/ND-CP.
Decision or document on land allocation, land allocation, national defense and security works approved by competent authority (applicable to military units, police, public service units under the Ministry of National Defense, Ministry of Public Security; state-owned enterprises assigned for management).
Document on legal representation, in case of procedures through a representative.
Agreement document to jointly issue a Certificate if there are multiple organizations with the same right to use and own.
Documents on financial obligation performance or documents on exemption or reduction of financial obligations (if any).
Design documents or construction acceptance documents according to the provisions of law on construction, in case of certifying ownership of construction works on agricultural land.
Thus, from August 25, 2025, when applying for a red book for the first time, organizations must fully prepare the above 8 types of documents for consideration and settlement by competent authorities.
It can be seen that, compared to before, the new regulations are more detailed and stricter. When applying for a red book for the first time, organizations will no longer have to worry about "having their documents returned due to lack of documents", because the list of documents has been clearly defined. The notable point is that this time the State requires a report on reviewing the current status of the land and supplementing the design and construction acceptance documents (if any), helping the issuance of red books to be more transparent and realistic.
