Previously, in Quang Ninh province, there were many strange projects such as afforestation or aquaculture that were licensed to be implemented in areas with open-pit coal. During the implementation of the project, people mainly took coal to sell. Everyone knows that the project is just a cover for coal mining. But digging up coal to sell is allowed because the law stipulates that when minerals are found, they are allowed to exploit them. Many people have become rich from such projects and of course, there must be someone “backing up” to be licensed to carry out the project to do so. Or people can rely on the implementation of dredging projects on river routes to exploit sand openly, while the exploitation of natural sand on rivers and canals has been banned. And that exploitation is also considered legal because it is considered mineral exploitation. The main purpose of such projects, everyone understands, but no one can do anything, because it is in accordance with the law.

The difficulty in handling the act of "backing" the violations is that the "backers" are people with certain positions and power in public agencies. Therefore, investigating and clarifying for handling is not easy, because they never come forward or leave anything that can be called evidence of their involvement. In other fields, there are similar types of “backing”, especially in the field of housing construction. Therefore, illegal and unlicensed constructions still appear in places no one expects.

To end this situation, it is necessary to consider those who “back up” the violations as criminals and hold responsible the leaders in the localities, sectors, and fields where such violations occur in order to have appropriate handling. Because if they are not criminals, it is very difficult to handle them harshly to deter and prevent them.
