Implementing Resolution No. 96/2015/QH13 dated June 26, 2015, of the National Assembly on strengthening measures to prevent wrongful convictions and ensure compensation for victims in criminal proceedings.

Recently, the Ministry of Public Security has actively coordinated with the Supreme People's Procuracy, the Supreme People's Court, and the Ministry of Justice to amend and supplement Joint Circular No. 17 dated November 14, 2015, and Joint Circular No. 08/2015/TTLT-BCA-VKSNDTC-TANDTC-BTP amending and supplementing some points of the circular, which has been signed and issued by the four aforementioned agencies...

Authorities took samples for analysis to determine the drug content.

Only four cases require mandatory drug content analysis, specifically:

Narcotic substances and precursors used in the production of narcotic substances, in solid form, are dissolved into a solution;

Narcotic substances and precursors used in the production of narcotic substances in diluted liquid form;

Opium residue;

Addictive drugs, psychotropic drugs.

In addition to the four cases stipulated in points a, b, c, and d, if there are grounds and it is deemed necessary, the People's Court may directly request expert examination to ensure that the trial is conducted in accordance with the law.

Accordingly, the Supreme People's Procuratorate issued Official Letter No. 4575/VKSTC-Department 4 guiding the procuratorial sector in implementing Joint Circular No. 08, including several key points such as:

*During the trial phase of drug cases, "if there are grounds and it is deemed necessary," the court will directly request expert examination to ensure the trial is conducted in accordance with the law, without returning the case file to the People's Procuracy at all levels for further investigation; nor will it consider this as grounds for overturning the verdict for reinvestigation, and it will not accept the appeal of the Procuracy.

* According to the Law on the Promulgation of Documents, Joint Circular No. 08 mentioned above only came into effect on December 30, 2015.

* For drug cases currently facing difficulties related to the determination of the quantity of seized narcotics, in accordance with the spirit of Official Letter No. 234 of the Supreme People's Court, the People's Procuratorates at all levels are requested to resolve the cases based on the provisions of the Criminal Code, Joint Circular No. 17, and Notice No. 408/TB-VKSTC dated June 30, 2015, of the Chief Procurator of the Supreme People's Procuratorate.
