The Minister of Agriculture and Environment issued Circular 16/2026/TT-BNNMT regulating the management of aquatic animal breeds, aquatic animal feed, and products for treating the aquaculture environment.

Specifically, the Circular stipulates the procedures for granting import licenses for aquatic animal breeds; and the procedures for granting export licenses for aquatic animal breeds.

According to the Circular, the competent authority for issuing and re-issuing import permits for aquatic species not listed in the List of aquatic species permitted for business in Vietnam as stipulated in Appendix IV attached to this Circular, for testing, scientific research, and display at fairs and exhibitions, is the Chairman of the People's Committee of the province where the organization or individual conducts the testing, scientific research, or display at the fair or exhibition.

The procedure for granting import licenses for aquatic animal breeds is as follows: Within 4 working days from the date of receiving a complete application, the Department of Agriculture and Environment will review the application and submit it to the Chairman of the Provincial People's Committee for consideration and decision on granting an import license to the organization or individual. If the import license is not granted, a written notification stating the reasons must be provided to the organization or individual.

In cases where a paper-issued import license for aquatic animal breeds is lost, damaged, or the address of the importing organization or individual changes, the organization or individual must submit an application to the competent authority that issued or reissued the import license for aquatic animal breeds. Within 2 working days of receiving the application, the Chairman of the Provincial People's Committee shall reissue the license. If the license is not reissued, a written response stating the reasons must be provided.

The Department of Agriculture and Environment monitors the participation of organizations and individuals registered for import in trade fairs, exhibitions, and scientific research.

When imported aquatic species are found to pose a risk to quality, the environment, or biosafety in Vietnam, the Chairman of the Provincial People's Committee shall consider and decide to inspect the management and production system of aquatic species in the exporting country.

The competent authority for issuing and re-issuing export licenses for aquatic species listed in the List of aquatic species prohibited from export or the List of aquatic species subject to conditional export but not meeting the conditions for scientific research or international cooperation purposes is the Fisheries and Aquatic Inspection Department.

The application for an export license includes: an application form for an export license; and documents proving that the export of aquatic species is for scientific research or international cooperation purposes.

Export licensing procedure: Within 7 working days from the date of receiving a complete application, the Department of Fisheries and Fisheries Inspection will review the application and issue an export license to the organization or individual. If an export license is not granted, a written notification stating the reasons must be provided to the organization or individual.

In cases where the paper-issued export license for aquatic animal breeding is lost or damaged, or if the address of the exporting organization or individual changes, the organization or individual must submit an application to the Department of Fisheries and Fisheries Inspection.

Within two working days of receiving the application, the Fisheries and Fisheries Inspection Department shall reissue the license. If the license is not reissued, a written response must be provided stating the reasons.
