If I fail the theory part of the driving license test, can I take the remaining parts?
My child took the A1 motorbike driving test, but failed the theory test and he said he could still take the remaining tests, the results were reserved. I want to know if this information is correct, where is it regulated? The issue of concern of Ms. Nguyen Thi Thoa (Quy Chau, Nghe An).
Reply: On February 28, 2025, the Minister of Public Security issued Circular 12/2025/TT-BCA regulating the testing, issuance of driving licenses; issuance and use of international driving licenses. Accordingly, in Clause 1,2, Article 12, Recognition of testing results is as follows:
- Consider recognizing test results for candidates taking driving tests for classes A1, A and B1.
+ Candidates who pass the theoretical and practical driving test in the diagram will be recognized as having passed the test.
+ Candidates who fail the theoretical test will continue to take the practical driving test in the picture.
+ Candidates who pass one of the theoretical or practical driving tests in the picture will have their test results reserved for 01 year from the date of passing the test; if they need to take the test, their name must be in the confirmation record of absence or failure of the previous test council and the driver's health certificate must still be valid or their name must be in the driving test information system.
- Consider recognizing test results for candidates taking driving tests for classes B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE.
+ Candidates who pass the theoretical test, simulated traffic test, practical driving test in the diagram and practical driving test on the road will be recognized as having passed the test.
+ Candidates who pass one of the theoretical tests, simulated traffic test, practical driving test in a diagram or practical driving test on the road will have their test results recognized and their test results will be retained for 01 year from the date of passing the test; if they want to retake the test, they must have a valid driver's health certificate and must be named in the absence or failure confirmation record of the Testing Council or be named in the driving test information system.
+ In case the candidate fails one of the above test contents, he/she will continue to test the remaining contents.
Thus, candidates who fail the theory part of the driving license test can still take the remaining test. Passed test results will be retained for 1 year. Unpassed test results can be re-registered.
