If I fail the theory part of the driving license test, am I still allowed to take the remaining parts?

My child took the A1 motorcycle driving test but failed the theory test. He said he can still retake the remaining parts and his result will be retained. I would like to know if this information is correct and where this regulation states it. (Ms. Nguyen Thi Thoa, Quy Chau, Nghe An)

ReplyOn February 28, 2025, the Minister of Public Security issued Circular 12/2025/TT-BCA regulating the examination and issuance of driver's licenses; and the issuance and use of international driver's licenses. Accordingly, Clauses 1 and 2 of Article 12 stipulate the recognition of examination results as follows:

- Review and approve the examination results for candidates taking the driving test for categories A1, A, and B1.

Candidates who pass both the theoretical and practical driving tests (within the designated area) will be considered to have passed the examination.

Candidates who fail the theoretical test will proceed to the practical driving test on the driving course.

Candidates who pass one of the theoretical or practical driving test sections will have their passing result reserved for one year from the date of passing; if they wish to retake the test, their name must be included in the previous examination board's record of absence or failure, and they must have a valid driver's health certificate or be listed in the driving test information system.

- Review and approve the examination results for candidates participating in driving tests for categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, and DE.

Candidates who pass the theoretical test, the traffic situation simulation test, the driving practice test on the course, and the driving practice test on the road will be recognized as having passed the examination.

+ Candidates who pass one of the theoretical examinations, the traffic situation simulation examination, the driving practice examination on the course, or the driving practice examination on the road will have their results for that examination recognized and retained for one year from the date of passing the examination; if they wish to retake the examination, they must have a valid driver's health certificate and their name must be included in the examination board's record of absences or failures, or their name must be listed in the driver's license examination information system.

+ If a candidate fails one of the above assessment areas, they will be allowed to continue taking the remaining assessment areas.

Therefore, it is correct that candidates who fail the theory section of the driving license test are still allowed to retake the remaining sections. Passed sections will be retained for one year. Sections that were not passed can be retaken.
