If a pawn shop accepts a customer's identity card as collateral, what is the penalty for this act, and will the card be confiscated? This is a question raised by Mr. Ho Van Chien (Hoang Mai commune, Nghe An province).

Reply:Based on point b, clause 4, clause 5, and point b, clause 6 of Article 11 of Decree 282/2025/ND-CP, the following is stipulated:

Article 11. Violations of regulations on the issuance, management, and use of citizen identity cards, identity cards, electronic identity cards, or identity certificates.

4. A fine of between VND 8,000,000 and VND 10,000,000 shall be imposed for any of the following acts:

a) Using counterfeit citizen identity cards, counterfeit identity cards, counterfeit electronic identity cards, counterfeit identity certificates, counterfeit confirmations of canceled personal identification numbers with counterfeit re-established personal identification numbers; using citizen identity cards or identity cards that have expired to commit illegal acts;

b) Pledging or accepting as collateral a citizen identification card, identity card, identity certificate, or confirmation of a cancelled personal identification number with a re-established personal identification number;

c) Renting or leasing citizen identity cards, identity cards, identity certificates, or confirmations of canceled personal identification numbers with re-established personal identification numbers.

5. Additional forms of punishment:

Confiscation of evidence and means used in committing administrative violations for acts violating the provisions of points b and c of clause 2, clause 3 and clause 4 of this Article.

6. Remedial measures:

a) Mandatory surrender of citizen identity card, identity card, identity certificate, or confirmation of canceled personal identification number with re-established personal identification number for violations of the regulations specified in point c, clause 1, and points a and d, clause 2 of this Article;

b) To compel the return of any illegal profits obtained from committing the violations specified in points b and c of Clause 4 of this Article.

Based on Clause 2, Article 5 of Decree 282/2025/ND-CP, the following is stipulated:

Article 5. Regulations on maximum fines and organizations subject to administrative penalties for violations.

1. The maximum fine in the field of preventing and combating domestic violence is VND 30,000,000 for individuals and VND 60,000,000 for organizations; the maximum fine in the field of security, order, and social safety is VND 40,000,000 for individuals and VND 80,000,000 for organizations; the maximum fine in the field of preventing and combating social evils is VND 75,000,000 for individuals and VND 150,000,000 for organizations.

2. The fines stipulated in Chapter II of this Decree are the fines applied to administrative violations committed by individuals. For organizations committing the same violation, the fine is twice the amount imposed on individuals.

Therefore, from December 15, 2025, the act of pawning an identity card may be subject to a fine of VND 8,000,000 to VND 10,000,000.
