From December 5th, land ownership certificates will include the names of all family members.

Effective from December 5, 2017, Circular 33/2017/TT-BTNMT of the Ministry of Natural Resources and Environment stipulates that land use right certificates (land title deeds) will list the names of all family members who jointly use the land.

Specifically, Circular No. 33/2017/TT-BTNMT of the Ministry of Natural Resources and Environment amends and supplements Point c, Clause 1, Article 5 of Circular No. 23/2014/TT-BTNMT (dated May 19, 2014) stipulating:

“For households using land, the information should be shown as “Household, including Mr.” (or “Household, including Mrs.”), followed by the full name, year of birth, name and number of the household head's identification document as stipulated in Point a of this Clause; and the permanent address of the household. If the household head does not have the right to use the household's common land, the representative should be another member of the household who also has the right to use the household's common land.”

From December 5, 2017, land use right certificates (land title deeds) will include the names of all family members.

Then add "Jointly using the land, jointly owning the property attached to the land (or jointly using the land or jointly owning the property) with … (list sequentially the full names, years of birth, names and identification document numbers of the remaining members of the household who share the right to use the land and the right to own the property attached to the land)".

Previously, Circular No. 23/2014/TT-BTNMT regulating the Certificate of Land Use Rights, Ownership of Houses and Other Assets Attached to Land only stipulated: For households using land, it should be recorded as "Household of Mr." (or "Household of Mrs."), followed by the full name, year of birth, name and number of the personal identification document of the head of the household as stipulated in Point a of this Clause; and the permanent address of the household. If the head of the household does not have the right to use the land jointly with the household, then the representative should be recorded as another member of the household who has the right to use the land jointly with the household.

If the head of the household or another representative of the household has a spouse who also has the right to use the household's land jointly, then the full name and year of birth of that spouse should also be recorded.

Thus, Circular 33/2017/TT-BTNMT has added the category of "remaining members of a household who share the right to use the land" to the land ownership certificate.
