From 2025, is it mandatory to buy motorbike insurance?
The new 2024 Law on Road Traffic Safety and Order takes effect from January 1, 2025. Is it mandatory to buy motorbike insurance? How much is the fine for not having motorbike insurance? This is a concern of Mr. Hoang Van Hung (Hung Nguyen, Nghe An).
Reply: According to Clause 1, Article 56 of the Law on Road Traffic Order and Safety 2024, the conditions for drivers participating in road traffic are stipulated. Accordingly:
Article 56. Conditions for drivers participating in road traffic
1. Drivers participating in road traffic must be of legal age and health; have a valid driving license with points remaining, appropriate to the type of vehicle being driven, issued by a competent authority, except for motorbike drivers specified in Clause 4 of this Article. When participating in road traffic, drivers must carry the following documents:
a) Vehicle registration certificate or certified copy of the vehicle registration certificate with the original confirmation document from a credit institution or foreign bank branch that is still valid in case the vehicle is mortgaged at a credit institution or foreign bank branch;
b) Driving license appropriate to the type of vehicle being driven;
c) Certificate of technical safety and environmental protection inspection for motor vehicles according to the provisions of law;
d) Certificate of compulsory civil liability insurance of motor vehicle owners.
Accordingly, in 2025, the Certificate of Compulsory Civil Liability Insurance of Motor Vehicle Owners will still be one of the documents that traffic participants are required to carry.
How much is the fine for not having motorbike insurance?
According to point b, clause 2, Article 18 of Decree 168/2024/ND-CP, it is stipulated as follows:
Article 18. Penalties and deduction of driving license points for violations of regulations on conditions for motor vehicle drivers
...
2. A fine of VND 200,000 to VND 300,000 shall be imposed for one of the following violations:
...
b) Drivers of motorbikes, mopeds, vehicles similar to motorbikes and vehicles similar to motorbikes do not have a valid certificate of compulsory civil liability insurance for motor vehicle owners;
…
Thus, from January 1, 2025, drivers of motorbikes, mopeds, and similar vehicles to motorbikes and similar vehicles to motorbikes without motorbike insurance will be fined from VND 200,000 to VND 300,000.
