Will motorcycle insurance be mandatory from 2025 onwards?
With the new Road Traffic Safety Law 2024, effective from January 1, 2025, is it mandatory to purchase motorcycle insurance? What is the fine for not having motorcycle insurance? This is a question from Mr. Hoang Van Hung (Hung Nguyen, Nghe An).
ReplyAccording to Clause 1, Article 56 of the 2024 Law on Road Traffic Order and Safety, which stipulates the conditions for drivers participating in road traffic:
Article 56. Conditions for drivers participating in road traffic.
1. Drivers participating in road traffic must be of the age and health required by law; possess a valid driver's license with remaining points, appropriate to the type of vehicle being driven, issued by a competent authority, except for motorcycle drivers as specified in Clause 4 of this Article. When participating in road traffic, drivers must carry the following documents:
a) Vehicle registration certificate or a certified copy of the vehicle registration certificate accompanied by the original confirmation document from a credit institution or foreign bank branch that is still valid in case the vehicle is mortgaged to a credit institution or foreign bank branch;
b) A driver's license appropriate for the type of vehicle being driven;
c) Certification of technical safety and environmental protection inspection for motor vehicles as prescribed by law;
d) Certificate of mandatory civil liability insurance for motor vehicle owners.
Accordingly, in 2025, the Certificate of Compulsory Civil Liability Insurance for Motor Vehicle Owners will still be one of the documents that road users are required to carry.
What is the fine for not having motorcycle insurance?
According to point b, clause 2, Article 18 of Decree 168/2024/ND-CP, the following is stipulated:
Article 18. Penalties and deduction of points from driver's licenses for violations of regulations concerning the qualifications of motor vehicle drivers.
...
2. A fine of between 200,000 VND and 300,000 VND shall be imposed for any of the following violations:
...
b) Drivers of motorcycles, mopeds, and similar vehicles who do not possess a valid mandatory motor vehicle liability insurance certificate;
...
Therefore, from January 1, 2025, drivers of motorcycles, mopeds, and similar vehicles without motorcycle insurance will be fined between 200,000 and 300,000 VND.
