The Provincial People's Committee provides feedback on draft legal documents prepared by the Department of Justice.
On the afternoon of February 23rd, the Provincial People's Committee held a meeting with relevant departments and units to hear and provide feedback on draft legal regulations prepared by the Department of Justice. Mr. Phung Thanh Vinh, Member of the Provincial Party Committee and Vice Chairman of the Provincial People's Committee, chaired the meeting.
At the meeting, the Provincial People's Committee heard a report from the Department of Justice on the draft Decision on decentralizing judicial tasks under the authority of the Chairman of the Provincial People's Committee to the Department of Justice; and the draft Decision on decentralizing judicial tasks under the authority of the Provincial People's Committee to the Department of Justice.

Regarding the draft Decision on decentralizing judicial tasks under the authority of the Chairman of the People's Committee to the Department of Justice, the Department of Justice proposes decentralizing 7 areas, including: For the field of civil registration, decentralizing the content of revoking and canceling civil registration documents, and the content of civil registration issued by the civil registration agency, and registrations made contrary to legal regulations.
The field of adoption is decentralized, specifying the content of confirmation for Vietnamese citizens residing in Vietnam who meet the eligibility requirements to adopt foreign children. The field of asset auction is decentralized, specifying the following: Issuance, revocation, and re-issuance of auctioneer practice certificates. The field of lawyer management is decentralized, specifying the following: Issuance, revocation, and re-issuance of lawyer practice certificates; and recognition of lawyer training abroad.

The field of notarization is decentralized to include: Appointment, reappointment, and dismissal of notaries; and recognition of equivalence for individuals trained in notarization abroad. The field of insolvency administrators is decentralized to include: Issuance, revocation, and re-issuance of insolvency administrator practice certificates.
The legal aid sector is divided into the following areas: Appointment, issuance of cards, dismissal, revocation, and re-issuance of cards for legal aid providers.

Regarding the draft Decision on decentralizing judicial tasks under the authority of the Provincial People's Committee to the Department of Justice, the drafting agency - the Department of Justice - proposes decentralizing three areas: In the field of notarization, the following contents are proposed: Establishing notary offices as private enterprises; Consolidating and merging notary offices as partnerships; Transferring all capital contributions of partners in a notary office; Selling notary offices as private enterprises; Revoking decisions permitting the establishment of notary offices.
The field of bailiff services is categorized into the following areas: Establishment of bailiff offices; Conversion of bailiff office types; Consolidation and merger of bailiff offices; Transfer of bailiff offices.
The field of Adoption is divided into the following areas: Handling adoptions of Vietnamese children by foreigners residing in Vietnam; Re-registration of adoptions involving foreign elements; Handling adoptions involving foreign elements in cases where stepfathers or stepmothers adopt their spouse's children; or where aunts, uncles, or grandparents adopt their nieces or nephews; and Handling adoptions involving foreign elements for children living in foster care facilities.

Regarding the content of the drafts, Vice Chairman of the Provincial People's Committee Phung Thanh Vinh unanimously approved them; and assigned the drafting agency to finalize the draft Decision for submission to the Provincial People's Committee meeting. In particular, he noted the concerns of the members regarding the decentralization of authority for establishing notary offices as private enterprises in particularly difficult areas; and the clear distinction between the authority of the Chairman of the Provincial People's Committee (signing documents confirming conditions) and the Provincial People's Committee (signing official administrative decisions) concerning adoption.

Next, the Provincial People's Committee listened to and agreed on the following contents: Draft Decision regulating the transfer of authority for certifying transactions from the People's Committees at the commune level to notary offices in the province; Draft Decision promulgating the list of commune-level areas where notary offices can be established and operate as private enterprises in the province.
Draft Decision on recognizing and announcing organizations and individuals participating in the network of legal consultants providing legal support to small and medium-sized enterprises in the province; Draft Decision amending and supplementing Decision No. 97/2025 stipulating the procedures for supporting legal consulting costs for small and medium-sized enterprises in the province.
Vice Chairman of the Provincial People's Committee Phung Thanh Vinh instructed the Department of Justice to incorporate the feedback and further refine the draft decisions.
