The practice of issuing "sub-licenses" disguised as supplementary documents and paperwork still persists.
The Minister of Justice stated that there is still a situation where "sub-licenses" are disguised as supplementary documents; the data exchange between agencies is not yet truly seamless, forcing businesses to declare the same information multiple times.
On the morning of July 18th, at the Government's regular meeting with the business community themed "Removing bottlenecks - Unlocking resources - Promoting growth," leaders of ministries directly discussed with businesses their recommendations within their scope of management, clarifying the handling direction and implementation roadmap to resolve difficulties.
Minister of Justice Hoang Thanh Tung stated that in the first six months of the year, the Government and ministries decisively directed the timely drafting and issuance of detailed regulations, totaling 225 documents, a 1.9-fold increase compared to the same period last year. This demonstrates the effort to definitively resolve the backlog of guiding documents.
Regarding the significant shift in legislative thinking, the Minister clarified that the approach has moved from amending individual documents to a comprehensive and synchronized review and amendment across many core areas such as land, investment, real estate business, housing, finance, taxation, and digital transformation and data.
In addition, the Government has been submitting to the National Assembly resolutions on specific policy mechanisms to definitively resolve long-standing stalled projects and address violations related to land, property, and the economy.
The approach to improving the law is guided by a constructive and developmental perspective, clearly distinguishing between acts of corruption and profiteering from errors arising during implementation that are not self-serving and are for the common good; separating the handling of responsibility for violating organizations and individuals from the unblocking of stalled resources; and, in particular, avoiding the criminalization of civil and economic relations.
The Minister of Justice shared that this not only helps maintain discipline but also strengthens investors' confidence in the legal security of Vietnam.
Alongside the positive results, the Minister also frankly acknowledged that there are still bottlenecks hindering business operations.
This includes overlapping regulations, delays in issuing detailed regulations leading to confusion in application; slow policy response mechanisms in some cases; the continued existence of "sub-licenses" disguised as supplementary documents; and the lack of seamless data exchange between agencies, forcing businesses to declare the same information multiple times.
In particular, the prevailing mentality of "fear of making mistakes, fear of responsibility" among some civil servants is affecting the progress of document processing and the trust of businesses. These are issues that need to be addressed in the coming period.
To continue supporting businesses, the Minister of Justice stated that the quality of policy review will be improved. The Minister emphasized the firm commitment to refraining from issuing regulations that create unnecessary administrative procedures or permits. All draft documents must be thoroughly assessed for feasibility and practical impact on businesses.
The Ministry of Justice will finalize a mechanism for handling violations that harmonizes discipline and development. The Minister stated that priority will be given to measures to remedy the consequences and clearly define individual responsibilities to facilitate businesses in quickly resuming operations after correcting violations.
Removing obstacles for the entire system of stalled real estate transactions.
Regarding the backlog of resettlement housing, Minister of Construction Tran Hong Minh stated that in response to feedback concerning the conversion of housing intended for resettlement into social housing or auctioning it off, the Ministry accepts this feedback. The Ministry of Construction will submit a proposal to the competent authority for consideration to amend and supplement the provisions on housing function conversion in the Housing Law.
According to the Minister of Information, as of 6 PM on July 17th, the outstanding inventory of commercial real estate (50-year lease type) nationwide currently stands at 22,300 units of all types.
He suggested that the Ministry of Agriculture and Environment remove obstacles related to land procedures. Along with the Housing Law and the amended Land Law, the Minister suggested that a solution is needed to address bottlenecks and resolve the entire real estate system's backlog that has persisted until now.
Deputy Minister of Industry and Trade Truong Thanh Hoai stated that the businesses' recommendations mainly relate to institutional breakthroughs to unleash resources in industry and trade. The current bottleneck lies not only in administrative procedures but also in management methods.
In many sectors of the Ministry of Industry and Trade, such as industry and energy, state agencies remain deeply involved in the investment, production, and business processes; while businesses need more autonomy and a more stable, transparent, and predictable investment environment to carry out their investment activities.
Regarding the proposal related to electricity pricing mechanisms, the Deputy Minister affirmed that ensuring energy for national development must be done at a reasonable cost. These are two issues that need to be simultaneously addressed, along with enhancing national energy self-reliance. The Ministry of Industry and Trade will study the mechanisms proposed by businesses to consider, incorporate, and refine relevant laws.
