Ms. Nguyen Thi Huyen, residing in Dien Chau district, asks: What types of land are included in the land allocation for railways? How are the allocation and leasing of land for railways regulated according to the 2024 Land Law?

Reply:

Article 209 of the 2024 Land Law stipulates the land designated for railways as follows:

1. Land designated for railways includes:

a) Land for constructing national and urban railway infrastructure; land for constructing government offices for regular operations within railway stations;

b) Land for the construction of specialized railway infrastructure and railway industrial facilities;

c) Land for constructing service facilities related to passenger transport, freight transport, and other commercial service facilities within the railway infrastructure construction area.

2. The allocation and leasing of land for railways shall be carried out as follows:

a) Land shall be allocated without collecting land use fees for land specified in point a, clause 1 of this Article;

b) Leasing land with annual rent payments and exempting land from rent for land specified in point b, clause 1 of this Article.

c) Leasing land and collecting annual land rent for land specified in point c, clause 1 of this Article.

3. For land designated for railways that was allocated or leased before the effective date of this Law, the State shall consider granting certificates of land use rights and ownership of assets attached to the land in the form prescribed in Clause 2 of this Article.

4. The provincial People's Committee is responsible for allocating land and assigning land to the People's Police force to ensure security and order in the railway station area.
