Previously, on August 15, 2021, the Provincial Police Investigation Agency issued Decision No. 110/VPĐTCAT to initiate a criminal case for the crime of "Fraudulent appropriation of property" atMinh Khang Urban Area Project(Full name: Project for the construction of a complex of hotels, supermarkets selling pharmaceuticals and medical equipment, and residential buildings in Nghi Phu commune, Vinh City)The project was developed by Minh Khang Company. On September 16, 2021, the Investigation Police Department of the Provincial Police issued a decision to prosecute Ms. Nguyen Thi Thu - Director of Minh Khang Company and Mr. Nguyen Dinh Khang - Head of the Minh Khang Urban Area Project Management Board for the crime of "Fraudulent appropriation of property".

Following the investigation, in January 2023, the Provincial People's Procuracy transferred the indictment and case file regarding the "Fraudulent appropriation of property" case involving the two spouses who are the directors of Minh Khang Company to the Provincial People's Court.

According to information from the Trial Council, this is the third time the Provincial People's Court has held a trial. Previously, both times the trial was canceled. On this third occasion, defendants Nguyen Dinh Khang and Nguyen Thi Thu, along with their defense lawyers, requested a postponement due to health issues and the absence of several individuals with relevant rights and obligations. However, after consulting with doctors at the Nghe An Provincial Police Detention Center and representatives from the Nghe An Provincial People's Procuracy assigned to prosecute at the trial, the Trial Council deliberated and decided to proceed with the trial.

Before announcing the indictment, a representative of the People's Procuracy of Nghe An province informed that, in addition to the crime of "Fraudulent appropriation of property" under Article 174 of the Penal Code, defendants Nguyen Thi Thu and Nguyen Dinh Khang were also prosecuted for the additional crime of "Abuse of trust to appropriate property" under Article 175 of the Penal Code.

According to the indictment, the Minh Khang Urban Area Project received detailed planning approval in Decision 521/QD-UBND.DT in 2007, with a total area of ​​7.86 hectares. The project is bordered to the west by Xo Viet Nghe Tinh Street, to the north by a planned 72m wide road, to the south by a planned 30m wide road, and to the east by Truong Van Linh Street.

According to Decision 521/QD-UBND.DT, this project will include a 3-4 star hotel complex along a 72m planned road; a supermarket for pharmaceuticals and medical equipment and office space for rent along Xo Viet Nghe Tinh road; a 4-story medical examination and treatment service area along a 30m planned road; and a sports and recreation area and green space located in the center of the planned area, covering more than 10,000m².²In addition, there are 5-story social housing, townhouses, villas, and garden houses... With a total construction area of ​​only about 1.77 hectares out of 7.86 hectares, the construction density on the total project area is only about 27%. During the implementation process, the Minh Khang Project has undergone several planning adjustments, resulting in the residential land area in this project increasing to over 16,554 square meters.².

After completing the project, Minh Khang Company sold land to customers under the guise of preliminary capital contribution contracts. Simultaneously, they used land use right certificates for some plots as collateral to borrow money to repay debts; and transferred some non-existent plots within the project to several individuals to misappropriate assets. The defendants, Nguyen Thi Thu and Nguyen Dinh Khang, also used non-existent plots, plots already sold to others, or plots already mortgaged to banks to continue using them as collateral to borrow money from other individuals and entities in the form of capital contribution contracts...
