What is the penalty for crossing a railway barrier?
Ms. Nguyen Thi Ha (residing in Vinh Hung ward, Nghe An province) asked: I see many people still deliberately crossing the barriers installed at railway crossings. May I ask, how is this behavior punished according to current legal regulations?

According to the provisions of Article 47 of Decree No. 100/2019/ND-CP, amended and supplemented in Clause 34, Article 2 of Decree No. 123/2021/ND-CP, the act of intentionally crossing the barrier at a railway crossing is a violation of road traffic rules and is subject to administrative penalties, depending on the type of violating vehicle.

Specifically:
- Pedestrians: Fine from 60,000 to 100,000 VND;
- Drivers and passengers of bicycles and motorbikes: Fine from 100,000 to 200,000 VND;
- Motorbike and motorbike drivers: Fine from 600,000 to 1,000,000 VND;
- Tractor and specialized motorbike drivers: Fine from 2,000,000 to 3,000,000 VND;
- Drivers of cars and similar vehicles: Fine from 4,000,000 to 6,000,000 VND.
Crossing railway barriers is not only a violation of the law but also poses a serious risk of accidents. Therefore, road users must strictly obey the signals, signs and instructions of the barrier staff to ensure safety for themselves and the community.
