What are the penalties for crossing a railway barrier?
Ms. Nguyen Thi Ha (residing in Vinh Hung ward, Nghe An province) asks: I see many people still deliberately crossing the barriers at railway level crossings. Could you please tell me what the penalties are for this behavior according to current laws?

According to Article 47 of Decree No. 100/2019/ND-CP, as amended and supplemented by Clause 34, Article 2 of Decree No. 123/2021/ND-CP, the act of deliberately crossing a closed barrier at a railway level crossing is a violation of road traffic regulations and is subject to administrative penalties, depending on the type of vehicle involved.

Specifically:
- Pedestrians: Fines ranging from 60,000 to 100,000 VND;
- For drivers and passengers of bicycles and motorbikes: A fine of 100,000 to 200,000 VND will be imposed.
- Drivers of motorcycles and mopeds: Fines ranging from 600,000 to 1,000,000 VND;
- For drivers of tractors and specialized vehicles: A fine of 2,000,000 to 3,000,000 VND will be imposed;
- Drivers of automobiles and similar vehicles: Fines ranging from 4,000,000 to 6,000,000 VND.
Crossing railway crossings not only violates the law but also poses a serious risk of accidents. Therefore, road users must strictly obey signals, signs, and instructions from crossing guards to ensure their own safety and the safety of the community.
