What criteria are used to determine land types according to the 2024 Land Law?
How is the determination of land type under the 2024 Land Law guided by law? This is a question of concern to Mr. Ngo Van Yem (Hoang Mai, Nghe An).
Answer: According to Article 10 of the 2024 Land Law, the determination of land types is as follows:
1. The classification of land is based on one of the following criteria:
a) Land use right certificate; House ownership and land use right certificate; Land use right, house ownership and other assets attached to the land certificate; Land use right and ownership of assets attached to the land certificate;
b) Documents proving land use rights as stipulated in Article 137 of this Law, in cases where a certificate has not yet been issued as stipulated in point a of this clause;
c) Decisions on land allocation, land lease, and permission for land use conversion issued by competent state agencies in cases where a certificate has not yet been issued as stipulated in point a of this clause.
2. In cases where the documents specified in Clause 1 of this Article are unavailable, and in cases where the land type determined on the issued documents differs from the land classification prescribed in this Law or differs from the current land use status, the determination of the land type shall be carried out according to the regulations of the Government.
