Do I need a building permit to build a detached house?
Mr. Nguyen Duc Thanh, residing in Vinh Loc ward (Nghe An province), is planning to rebuild his old, dilapidated house. He recently heard that new regulations have emerged suggesting that some cases of individual house construction are exempt from building permits. So, in Mr. Thanh's case, is a building permit mandatory, or is he exempt under current regulations?

According to the 2014 Construction Law, as amended and supplemented in 2025, a construction permit is a legal document issued by a competent authority, allowing individuals or organizations to carry out new construction, repair, renovation, or relocation of construction works. There are four types of construction permits: new construction permits, repair and renovation permits, relocation permits, and temporary construction permits.
In principle, all construction projects must have a permit, except for cases exempted as stipulated in Clause 2, Article 89 of the amended Construction Law.
Specifically for individual houses, only two cases are exempt from construction permits. Firstly, individual houses under 7 stories located within urban development or housing projects with approved 1/500 scale detailed planning. Secondly, individual houses classified as Grade IV constructions, built in rural, mountainous, or island areas, not located within urban planning or functional zone planning areas; excluding structures located within conservation areas or historical-cultural relic sites.
Therefore, to determine whether a building permit is required, you need to consider whether your planned house falls into one of the two categories mentioned above.
If you are eligible for exemption, you only need to notify the local state management agency for construction of the commencement date and submit the construction design documents for monitoring and management.
In cases not eligible for exemption, it is mandatory to apply for a construction permit at the commune/ward People's Committee, as stipulated in Clause 1, Article 4 of Decree 140/2025/NĐ-CP.
