Trial of neighbor who sexually abused 5th grade female student and caused her to commit suicide
After being repeatedly abused, K.’s family filed a complaint, but the authorities were slow to deal with Huu Be’s actions. K. committed suicide by taking poison and leaving a suicide note.

On the morning of January 18, the People's Court of Ca Mau province tried the child molestation case of defendant Huu Be (58 years old, Thoi Binh district, Ca Mau province).The trial is scheduled to last for two days, January 18 and 19.
According to the indictment of the People's Procuracy of Ca Mau province, from mid-June to September 2016, Huu Be took advantage of the innocence and lack of knowledge of HMK (born in 2004, a 5th grade student, the child of defendant Be's neighbor) to seduce, call, write appointment papers, and give money to commit obscene acts against her.
After being repeatedly abused, on the afternoon of February 10, 2017, K.’s family discovered that she had taken pills to commit suicide. Although she was taken to the emergency room, K. died the following day.
The indictment determined that Huu Be had committed 8 crimes.committed the act of molesting K.
"Be committed an indecent act against K. when she was under 13 years old. Therefore, the above act of Huu Be constituted the crime of indecent assault against a child, a case of committing the crime multiple times," the indictment prosecuted.
The indictment also stated that regarding the forensic examination conclusion that K.'s hymen was torn, K. also confessed to being raped.
However, based on the documents and evidence collected by the investigation agency, there was not enough basis to prosecute Huu Be for child rape, so the investigation agency separated the investigation for later handling.
The decision to separate the criminal case was signed by Colonel Ngo Tan Quoc (Deputy Head of the Investigation Police Agency of Ca Mau Province Police) on November 17, 2017 and transferred to the Provincial People's Procuracy.
As reported, this case has received special attention from the public because the victim's family is upset because K. committed suicide but the authorities are still slow to handle Huu Be's actions.
After knowing the incident, in August 2016, Ms. Huu Thi Loi (K.'s mother) and K. repeatedly filed complaints against Mr. Huu Be (neighbor) for sexually abusing the child.
On September 30, 2016, Ms. Loi received a notice of the examination conclusion, the child's hymen was torn, but the Police Investigation Agency decided not to prosecute the case because "there was only K.'s testimony, no other documents or evidence to prove that Mr. Be had committed acts of child rape and child molestation."
On February 10, 2017, K. committed suicide by taking poison, leaving behind a suicide note.
Ms. Loi took the petition to all the authorities in Ca Mau province and Ho Chi Minh City.

In March 2017, the Investigation Police Agency announced that it had canceled the decision not to prosecute the criminal case and issued a decision to prosecute the case to investigate Mr. Huu Be on two charges of child rape and child molestation.
In September 2017, the People's Procuracy of Ca Mau province approved the prosecution and detention of Huu Be to investigate the act of child molestation.
In November 2017, the Ministry of Public Security decided to remove Lieutenant Colonel Tran Hong Loc - who signed the decision not to prosecute the criminal case in September 2016 - from his position as deputy head of the investigation agency, and Lieutenant Colonel Do Tan Dat - who signed the decision not to prosecute the criminal case - from his position as team leader and intermediate investigator.
These two investigators were also warned by the Party and transferred to other jobs.
Previously, the Chief of the Government Office also signed a document conveying the Prime Minister's direction requesting the Ministry of Public Security and the People's Committee of Ca Mau province to direct functional forces to urgently investigate and strictly handle this case according to the law.
At the same time, consider the responsibility of Ca Mau Provincial Police in the investigation process and decide not to prosecute the criminal case.
