On the morning of July 29th, the Nghe An Provincial People's Court opened a criminal appeals trial against Le Ngoc Ha (born in 1985), residing in Hong Son Ward, Vinh City, for the crimes of disturbing public order and child abuse. The trial was opened due to the defendant's appeal requesting a reduced sentence.
According to the indictment, due to a conflict, Le Ngoc Ha's wife left home. On the morning of November 21, 2018, Ha took his son, Le Ngoc H. D. (born in 2017), to a guesthouse on Nguyen Thuc Tu Street (Vinh Tan Ward) to look for his wife.
After searching but failing to find his wife, Ha carried his young child and climbed the stairs through the ventilation shaft onto the third-floor roof of the boarding house, shouting and causing a disturbance. He then threatened to stab the child with scissors and toss the child to the ground. He also held the child upside down by one arm or leg, swinging it back and forth in the open space above the roof, at a height of over 10 meters, threatening to drop the child.

Authorities used loudspeakers to persuade Ha to remain calm and not endanger the child, while simultaneously deploying rescue efforts to ensure the child's safety in case the suspect acted violently and threw the child down.
At around 11:00 AM that same day, while Le Ngoc Ha was carrying her child on the roof of a two-story house, the child fell onto the corrugated iron roof below. Ha jumped after the child, grabbed her, and threw her to the ground. Fortunately, rescue forces were able to catch the child in time, ensuring her safety. Le Ngoc Ha also jumped from the roof and was immediately apprehended and arrested by the police.
At the first-instance trial held in April 2019, the defendant Ha admitted to all criminal acts. The first-instance court sentenced Le Ngoc Ha to a total of 6 years and 6 months in prison for two offenses: disturbing public order and child abuse (3 years in prison for disturbing public order and 3 years and 6 months in prison for child abuse).
Believing the sentence was too harsh, Le Ngoc Ha filed an appeal requesting a reduction in punishment. In his appeal, Ha cited his difficult circumstances and stated that he had recognized his mistakes. His mother also submitted a petition requesting leniency for her son.
The appellate court noted that the lower court had considered the mitigating circumstances of the defendant. At this trial, since the defendant did not present any other reasons for leniency compared to the lower court, the appeal of Le Ngoc Ha was rejected. Le Ngoc Ha was sentenced to 3 years imprisonment for disturbing public order and 3 years and 6 months imprisonment for child abuse. The defendant is required to serve a total sentence of 6 years and 6 months imprisonment.
Le Ngoc Ha has a prior conviction for drug-related offenses, has been fined for disturbing public order, and is a heavy drug addict who has undergone rehabilitation multiple times without success.
