Speeding is a common violation of many drivers. Here are some things violators need to know.

Right to request the provision of images of speeding behavior

According to Point a, Clause 3, Article 19 of Circular 65/2020/TT-BCA, in case the violator requests to see the images and recorded results of the violation, the traffic police must let the violator see the recorded images. At the same time, when there are no direct images, the traffic police must guide the violator to see the images and recorded results when they come to handle the violation at the unit's headquarters.

Thus, violators are completely allowed to request to see the violation image. In case the traffic police do not have the violation image, they must guide the violator to the unit's headquarters, and must record in the violation report that the violation image has not been provided. At the traffic police headquarters, it is mandatory to let the violator see the violation image.

Note when viewing speeding images

In Clause 3, Article 7, Circular 06/2017/TT-BGTVT stipulates that when viewing images of violations, the following factors must be noted:

- For recording devices when taking real-life images, it must ensure that the image displays the date, month, year, hour, minute, second and location of the photo.

- For moving image recording devices (cameras) when recording, capturing real images, image clips must ensure that the date, month, year, hour, minute, second, and location of recording, capturing images, and clips are displayed.

- The actual speed on the image matches the prescribed speed of the road section.

- The image on the recording device must be exactly the vehicle you are driving (with a red mark on the recording device showing your vehicle as the target).

Cases of speeding but not fined

According to Decree 100/2019/ND-CP (amended by Decree 123/2021/ND-CP), vehicle drivers will only be fined for exceeding the maximum speed limit when exceeding the prescribed speed limit of the road section by 5 km/h or more.

Thus, in cases of exceeding the maximum speed by less than 5 km/h, there will be no administrative penalty.

Traffic police uniformwhen handling speeding errors

According to Point b, Clause 1, Article 11, Circular 65/2020/TT-BCA, traffic police who shoot speed cameras can be plainclothes and stand at a distance from the traffic police post.

Also according to Point a, Clause 1, Article 11, Circular 65/2020/TT-BCA, traffic police drawing up records of violations are required to wear police uniforms and People's Public Security numbers.

It can be seen that traffic police wearing plain clothes to shoot speed is in accordance with regulations. However, when signing the record of administrative violation, the traffic police writing the record must wear the correct police uniform.
