5 outstanding policies effective from June 2018

1. Illegal or unauthorized construction must stop to apply for a construction permit.

This is one of the important contents in Circular 03/2018/TT-BXD detailing a number of articles of Decree 139/2017/ND-CP regulating administrative sanctions for violations in construction investment activities; exploitation, processing and trading of minerals as construction materials; real estate business, management and use of houses and offices.
Accordingly, construction works that are being constructed without a permit or without a permit must stop from the time of the administrative violation record.
Within a maximum period of 60 days from the date of the record, the violator must carry out the procedure to request the issuance or adjustment of a construction permit and present it to the competent authority for sanctioning.
Individuals and organizations that violate the law may only continue construction if the inspection report and record of the current status of the construction confirm that the current status of the construction is consistent with the granted or adjusted construction permit.
The Circular takes effect from June 12, 2018.
2. Publicize the list of people with pharmaceutical practice certificates

According to Circular 07/2018/TT-BYT, pharmaceutical business establishments must notify the Department of Health of the province or centrally-run city of the list of people with a Pharmacy Practice Certificate practicing at the establishment.
The notification period is 30 days from the date of commencement of operation or from the date of change in the person granted the Certificate of Pharmacy Practice currently practicing.

The Circular takes effect from June 1, 2018.
3. Support up to 90% of the cost when purchasing agricultural insurance

This is the support level applied to individuals engaged in agricultural production belonging to poor and near-poor households as prescribed in Decree 58/2018/ND-CP on agricultural insurance.
For the remaining agricultural production subjects who are not poor or near-poor households, a maximum of 20% of agricultural insurance premiums will be supported.
Risks caused by natural disasters and epidemics will be covered by insurance such as: Storms, tropical depressions, tornadoes, lightning, floods, landslides, droughts, cold snaps, hail, etc. and infectious diseases of animals according to the List of animal diseases that must be declared epidemics.
The Decree takes effect from June 5, 2018.
4. Drug names must not be of an advertising nature.

According to the provisions of Circular 01/2018/TT-BYT effective from June 1, 2018, the trade name of the drug on the drug label must ensure:
No advertising;
Do not mislead about the ingredients and origin of the drug;
Do not mislead or exaggerate the effects, effectiveness, indications of the drug and some other notes.
5. Implement the one-stop, one-stop mechanism in handling administrative procedures

Decree 61/2018/ND-CP on implementing the one-stop shop and inter-connected one-stop shop mechanism in handling administrative procedures.
Accordingly, the subjects of application of this document include military officers, police officers of the Ministry of National Defense, Ministry of Public Security; and cadres, civil servants and public employees of the following agencies:
- Ministries, ministerial-level agencies; general departments and equivalent agencies, departments and divisions under ministries and ministerial-level agencies have the tasks and powers to handle administrative procedures and participate in the process of handling administrative procedures;
- People's Committees at all levels; specialized agencies under the People's Committees at provincial and district levels; management boards of industrial parks, export processing zones, economic zones, and high-tech zones have the duties and powers to resolve administrative procedures.
The Decree takes effect from June 21, 2018.
