(Baonghean.vn) - The inspection results of the Provincial People's Committee show that the issuance of the Land Use Right Certificate to the Provincial Boarding High School for Ethnic Minorities is in accordance with regulations, all 5 teachers' households living in the school's dormitory area do not have the right to use the land at this location.
On May 8, the Provincial People's Committee Office said that the Provincial People's Committee leaders had just issued a document announcing the results of the inspection and review of the dossiers for granting Land Use Right Certificates and the handling plan.petition at Nghe An Ethnic Boarding High School.

The inspection results show that the Provincial People's Committee issued a Decision on recognizing land use rights and granting a Certificate of land use rights to Nghe An Ethnic Boarding High School in 2019 in accordance with legal regulations. The process and procedures for the dossier were implemented according to the provisions of Article 25, Decree No. 43/2014/ND-CP dated May 15, 2014 of the Government; Article 8, Circular No. 24/2014/TT-BTNMT dated May 19, 2014 of the Ministry of Natural Resources and Environment; Clause 1, Article 5, Decision No. 81/2014/QD-UBND dated October 27, 2014 of the People's Committee of Nghe An province.

The fact that Nghe An Ethnic Boarding High School did not fully report the current status in the application for a Certificate of Land Use Rights (not declaring that there were 5 collective houses), the Provincial Land Registration Office, Vinh City People's Committee, and Ha Huy Tap Ward People's Committee did not fully report to the Department of Natural Resources and Environment the current status of the land area of the 5 collective houses: This content has been concluded by Vinh City People's Committee and Ha Huy Tap Ward People's Committee, affirming that the entire area with 5 collective houses is part of the land area that the Provincial People's Committee has allowed Nghe An Ethnic Boarding High School (formerly Nghe Tinh Highlands High School) to use since 1984.
“The omission in the process of declaration, review and recognition of land use rights in 2019 did not change the results of granting the Certificate of Land Use Rights to Nghe An Boarding High School for Ethnic Minorities and 5 households using land in the Collective Housing Area (including Mr. Nguyen Van Ky's household) did not have the right to use land for the above location. On the other hand, based on the provisions of Clause 2, Article 106 of the 2013 Land Law: The omission in declaration and inspection of the current status did not lead to incorrect land use area and land users, so it is not a case where the State revokes the granted Certificate of Land Use Rights”, the announcement of the inspection results of the Provincial People's Committee stated.
Regarding the content, the Department of Natural Resources and Environment proposed the Provincial People's Committee to allow the Vinh City People's Committee to continue applying Decision No. 78/2014/QD-UBND dated October 27, 2014 of the Provincial People's Committee to consider and allocate residential land without auction to Mr. Nguyen Van Ky according to Decision No. 78/214/QD-UBND dated October 27, 2014 of the Provincial People's Committee if qualified. Currently, Decision No. 78/2014/QD-UBND dated October 27, 2014 of the Provincial People's Committee has expired since March 18, 2024.
Therefore, the Provincial People's Committee assigned the Department of Natural Resources and Environment to chair a meeting including: Provincial Inspectorate, Department of Justice, Department of Education and Training, Vinh City People's Committee, Nghe An Ethnic Boarding High School to review and advise the Provincial People's Committee to resolve the above content to ensure compliance with legal regulations. The results will be reported to the Provincial People's Committee before May 31, 2024.

Previously, as Nghe An Newspaper hadmany articles,In 2006, the provincial Boarding High School for Ethnic Minorities lent three teachers’ dormitories and two other families land within the school grounds to build houses. The loan contract clearly stated that these five teachers had to commit to “not expanding beyond the designated area; The duration of use was until the school had a need, with at least 12 months’ notice given so that the families could find a place to live…”.
However, during their stay, many households violated their contract commitments by renovating and expanding beyond the lent area without the school's permission. After that, some people retired and returned to their hometowns 15 years ago, and some people built their own houses outside long ago but still refused to return the dormitory to the school.
In 2019, after requesting funding to invest in the dormitory project for students, the school leaders worked with 5 households, asking them to move within 1 year so that the school could clear the ground to build a dormitory for students as committed in the contract. At that time, only 1 household had no comments. The remaining households asked for 3 years to arrange to move. The school agreed to the 3-year period.
However, after 3 years, by October 2023, the project was started but 5 households still refused to hand over the site for construction. The construction unit had to send many documents to the investor complaining about the delay in handing over the site, causing workers to wait for work and the risk of having their investment capital cut off due to slow progress.
After hundreds of meetings and campaigns, up to now, 3 households who borrowed the school's dormitory have agreed to move out and hand over the premises. The other 2 households who used their own money to build on the school's land have not yet returned it./.
