5 cases eligible for staff reduction under new regulations
The Government issued a decree specifying the subjects eligible for the policy of streamlining payroll.
The Government issued Decree No. 154 regulating staff streamlining, which officially took effect today (June 16). This is an important legal document, marking a step forward in efforts to reform administration, streamline the state apparatus and improve the effectiveness of public management.
This Decree specifically stipulates the subjects, principles, policies and responsibilities for implementing staff streamlining in agencies, organizations and public service units of the Party, State, Vietnam Fatherland Front, and socio-political organizations from the central to communal levels.

Target groupthe firstare cadres, civil servants, public employees; commune-level cadres, civil servants and people working under labor contracts who are subject to the same policies and regimes as civil servants according to the Government's regulations (hereinafter referred to as employees), if they fall into one of the following cases: civil servants, public employees and redundant employees due to the reorganization of the apparatus, except for those who enjoy policies and regimes in the implementation of the reorganization of the apparatus of the political system according to separate regulations of the Government.
Cadres, civil servants, and public employees in leadership and management positions who cease to hold leadership and management positions or titles or are appointed or elected to leadership and management positions with lower salary or leadership allowance due to organizational restructuring; individuals who voluntarily reduce their staff and are approved by the agency, organization, or unit directly managing them (except for beneficiaries of policies and regimes in the implementation of organizational restructuring of the political system according to separate regulations of the Government).
Cadres, civil servants, and public employees in leadership and management positions and titles cease to hold due to restructuring or improving the quality of the leadership and management team according to a decision of a competent authority or due to a decision of a competent authority to cease holding a leadership and management position; individuals voluntarily reduce their staff and are approved by the agency, organization, or unit directly managing them.
In addition, there are surpluses due to reviewing and rearranging personnel according to the decision of competent authorities or surpluses due to public service units rearranging personnel to implement the autonomy mechanism; surpluses due to restructuring of cadres, civil servants and public employees according to job positions but cannot be arranged or assigned to other jobs or can be arranged to other jobs but the individual voluntarily reduces the payroll and is agreed by the agency, organization or unit directly managing them; not having achieved the training level according to the professional and technical standards prescribed for the job position being held but there is no other suitable job position to arrange and cannot be arranged for retraining to standardize professional and technical skills or the agency arranges other jobs but the individual voluntarily reduces the payroll and is agreed by the agency, organization or unit directly managing them.
Individuals who in the previous year or in the year of streamlining the payroll are classified as not fulfilling the tasks associated with the performance of assigned duties and responsibilities; in the previous year or in the year of streamlining the payroll are classified as fulfilling the tasks but the individual voluntarily performs streamlining the payroll and is approved by the agency, organization or unit directly managing them; in the previous year or in the year of streamlining the payroll are classified as having a total number of days off work due to illness equal to or higher than 200 days, with confirmation from the Social Insurance agency to pay sickness allowance according to current regulations of law; In the previous year or in the year of considering streamlining the payroll, the total number of days off work is equal to or higher than the maximum number of days off due to illness as prescribed by the law on social insurance, with confirmation from the Social Insurance agency paying sickness allowances according to current regulations of the law, the individual voluntarily conducts streamlining the payroll and is approved by the agency, organization or unit directly managing it.
Mondayare those who work under an indefinite-term labor contract to perform professional and technical jobs in the list of specialized job titles and shared professional job titles in public service units according to Government regulations, surplus due to restructuring of the unit's human resources according to the decision of the competent authority, or surplus due to rearrangement of the apparatus (except for beneficiaries of policies and regimes in the implementation of rearrangement of the apparatus of the political system according to separate regulations of the Government).
Tuesdayis a person working under an indefinite-term labor contract performing support and service work in administrative agencies and public service units according to the provisions of law, redundant due to organizational restructuring (except for beneficiaries of policies and regimes in the implementation of organizational restructuring of the political system according to separate regulations of the Government).
Wednesdayis a non-professional activist at the commune level who has retired since the implementation of the 2-level local government model according to the provisions of the Law on Organization of Local Government.
Thursdayis a non-professional worker in a village or residential group who is redundant due to the arrangement of the village or residential group and must retire immediately from the time of the arrangement decision of the competent authority.
Clearly defining specific cases is an important step to ensure that the policy of streamlining the payroll is implemented in a focused manner, without causing major disruptions, while aiming at the goal of building a professional, honest, effective and efficient administrative apparatus.
