9 new policies take effect from September 2017

(Baonghean.vn) - From September 1, 2017, many new policies on education, healthcare, social assistance and many other fields will come into effect.

1. Equip yourself with knowledge to prevent online school violence

This is a prominent measure mentioned in Decree 80/2017/ND-CP regulating a safe, healthy, friendly educational environment and preventing and combating school violence. In addition, the Decree also mentions other measures, specifically:

- Education, consulting knowledge and self-protection skills for learners;

- Propagating and disseminating to raise awareness among learners, managers, teachers, staff in educational institutions, learners' families and the community about the dangers and consequences of school violence;

- Publicize plans to prevent and combat school violence and channels for receiving information and reporting school violence;

- Organize inspection, monitoring, collection and processing of information related to school violence;

- Implement positive, non-violent educational methods for learners.

From September 5, 2017, Decree 80/2017/ND-CP officially comes into effect.

2. General knowledge when taking the exam to promote lecturers from level II to level I

The Ministry of Education and Training has just issued Circular 18/2017/TT-BGDDT stipulating the conditions, contents, and forms of the exam for promotion of professional titles (CDNN) of teaching staff in public higher education institutions. Accordingly, the general knowledge exam when taking the exam for promotion from CDNN to senior lecturer (grade II) will include the following outstanding contents:

- The Party's guidelines and policies, the State's policies and laws on education and training in general and university education in particular;

- Viewpoints and strategic orientations for the development of the school's training sectors or majors;

- Law on civil servants in accordance with the standards of senior lecturers (grade I);

- The knowledge capacity of the exam questions and exam content on education and training is 70%, on civil servant law is 30%.

In addition, Circular 18/2017/TT-BGDDT (effective from September 5, 2017) also stipulates that the general knowledge test will be in essay form within 180 minutes.

3. Price level for calculating water resource exploitation rights

This is a notable content mentioned in Decree 82/2017/ND-CP regulating the method of calculation and collection level of water resource exploitation right (WRL) fee issued by the Government. Accordingly, the price for calculating WRL fee for hydropower production is 70% of the electricity price used to calculate water resource tax for hydropower production.

In addition, the price for calculating water resource tax for cases other than hydropower production is the price for calculating water resource tax issued by the People's Committee of the province or centrally-run city where the project is located.

Decree 82/2017/ND-CP takes effect from September 1, 2017 and abolishes the provisions in Article 40, Clause 3, Article 47 of Decree 201/2013/ND-CP dated November 27, 2013 of the Government.

4. Determine the actual remaining value of rural clean water projects

This is a new point in Circular 76/2017/TT-BTC amending Circular 54/2013/TT-BTC regulating the management, use and exploitation of centralized rural clean water supply works (effective from September 10, 2017).

Accordingly, the works to determine the actual remaining value include:

- The project has been assigned to the management entity (including public service units, commune-level People's Committees, cooperatives, etc.) but the operation is not effective;

- The project has not been assigned to the management entity as of September 10, 2017;

- Projects received for delivery since September 10, 2017 without documents or with documents that are not complete according to the provisions of law on construction investment.

5. 20 industries transferred from public career to joint stock company

On July 17, 2017, the Prime Minister issued Decision 31/2017/QD-TTg on the list of sectors and fields of operation of public service units to be transformed into joint stock companies in the period 2017 - 2020. Accordingly, the State holds less than 50% of charter capital or does not hold shares in public service units to be transformed into joint stock companies in 20 specific sectors and fields such as:

- Consulting services on tax, accounting, auditing,...

- Employment services, sending Vietnamese workers to work abroad under contract.

- Construction inspection.

- Real estate management, markets, shopping centers.

- Developing infrastructure and support services in industrial parks and industrial clusters.

Decision 31/2017/QD-TTg takes effect from September 1, 2017.

6. Priority order in considering promotion of medical officer titles

Circular 29/2017/TT-BYT stipulates standards, conditions, contents, and forms of consideration for promotion of professional titles of health sector civil servants.

Accordingly, if the number of people eligible for promotion is greater than the number of people ensuring the staff structure of the public health service unit, the Council for considering promotion of professional titles will prioritize consideration in the following order:

- Scientific research achievements;

- Number of years holding current professional title;

- Results of evaluation and classification of civil servants for 2 consecutive years preceding the year of promotion consideration;

- Interview results (if any).

Determination of successful candidates is carried out according to the Regulations on considering promotion of professional titles.

In case an official fails the professional title promotion exam according to regulations, the result will not be retained for the next time.

7. From September 1, 2017, allowing borrowing bonds for sale

This is one of the principles for borrowing Government bonds (G-bonds) at the Hanoi Stock Exchange (HOSE) stated in Circular 10/2017/TT-BTC amending Circular 234/2012/TT-BTC guiding the management of G-bond transactions.

Accordingly, borrowing of Government bonds is carried out according to the agreement of the parties and through the trading system at the Hanoi Stock Exchange or on the securities lending system at the Vietnam Securities Depository Center, ensuring the following principles:

- Only trading members who are members bidding for Government bonds are allowed to borrow Government bonds to sell according to the regulations of the Hanoi Stock Exchange;

- The maximum loan term is 180 days and must not exceed the remaining term until maturity of the Government bond;

- The loan must be repaid with borrowed Government bonds, in case there are not enough, it can be repaid with equivalent transferable Government bonds;

- The parties concerned shall agree and be responsible for the contents related to borrowed and repaid assets, secured assets, loan interest rates and other terms in compliance with legal regulations.

8. Increase monthly allowance for retired commune officials

Starting from September 1, 2017, the monthly allowance for retired commune, ward and town officials will be adjusted up based on the allowance level prescribed from July 1, 2017. Specifically:

- Former Party Secretary and Chairman of the Commune People's Committee receive: 1,846,000 VND/month.

- Former officials who are Deputy Secretary, Vice Chairman, Standing member of the Party Committee, Secretary of the People's Committee, Secretary of the Commune People's Council, Commune Team Leader, and Commune Police Chief are entitled to: 1,786,000 VND/month.

- The remaining positions receive: 1,653,000 VND/month

9. Reduce criteria when evaluating civil servants at the level of completing tasks well and completing tasks

That is the content mentioned in Clause 3, Clause 4, Article 1 of Decree 88/2017/ND-CP on amending and supplementing a number of articles of Decree 56/2015/ND-CP in evaluating and classifying cadres, civil servants and public employees. Accordingly, from September 15, the criterion of "having at least 01 scientific work, project, topic or initiative applied and bringing about effectiveness in performing professional and occupational work recognized by competent authorities" will be removed.

Thus, only civil servants who are assessed as having completed their tasks excellently must meet the criteria for scientific works, projects, topics or initiatives as above. This regulation comes into effect from September 15, 2017.
