9 years in prison for female explosives dealer

On the morning of August 11, 2016, the Provincial People's Court opened a first-instance criminal trial to try the case of illegal trading of explosives against Duong Thi Ha (born in 1980), residing in Truong Lam commune, Tinh Gia, Thanh Hoa.
According to the indictment, in 2015, Ha went to Yen Tinh commune (Tuong Duong district) to work as a stone quarryer, so he had the idea of going to Thanh Hoa to buy explosives to bring to Tuong Duong to sell for profit. On February 17, 2016, Ha called a man named Viet (living in the same commune) to ask to buy explosives, but this man did not agree to sell to Ha.
On February 29, 2016, Viet called Ha and said he had 168kg of explosives, 3,000 detonators, and a price of 19 million VND. Ha agreed to buy them. The two agreed on a place to deliver the explosives, but Viet did not come and sent another person (whom Ha did not know) to deliver the explosives and receive the money.

Knowing that her brother Duong Xuan Hung was also going to Nghe An, Ha asked for a ride and put all the explosives in the trunk of the car, lying that they were luggage and personal belongings. At about 22:30 on February 29, 2016, when she arrived at Quynh Thien ward, Hoang Mai town, she was discovered and caught red-handed by the Investigation Security Department of Nghe An Province Police. Because she was raising a child under 36 months old, Ha was released on bail to serve the investigation.
The Criminal Investigation Department of Nghe An Province Police determined that the evidence seized from Ha included 168kg of Amonit explosive (an industrial explosive, often used to break rocks, open roads or exploit minerals); 3,000 No. 8 detonators.
At the trial, Duong Thi Ha admitted her crime and hoped to receive leniency from the law so she could return home to take care of her children.
The presiding judge determined that Duong Thi Ha’s actions were dangerous, violated the State’s monopoly on explosives management, and committed a crime with a large amount of evidence… requiring a severe enough sentence to serve as a deterrent. However, considering that the defendant confessed honestly, repented, and while on bail awaiting trial, helped a pedestrian in an accident, which was confirmed by the local authorities, she should be given mitigating circumstances according to the law.
Considering the case as a whole, the People's Court sentenced Duong Thi Ha to 9 years in prison, the prison term calculated from the time of arrest to serve the sentence, minus the 10 days of detention before that.
