Coming from the same hometown of Nghi Loc district, Phan Truong Phi (born in 1985), residing in Nghi Lam commune, and Dau Thi Hue (born in 1985), residing in Nghi Cong Nam commune, did not know each other. Until Phi went to work in the South, Hue stayed at home and a friend gave her their phone number, so the two often texted and chatted with each other.

After a period of texting back and forth, the two decided to meet. Phi went back to his hometown to meet Hue. After exactly 3 days of meeting, Phi decided to bring Hue home to meet his family and ask for her hand in marriage. Before the "love at first sight" situation, both families were afraid that the two young people did not understand each other enough to get married, so they opposed it. Ignoring all advice, Phi decided to marry Hue without a wedding. The two went to the commune to register their marriage and then moved to Dak Lak to do business.

Real life is not as sweet as the loving messages between the two people on the phone. About a month after deciding to be together, Phi and Hue had conflicts and argued with each other frequently. Hue left for Lam Dong, Phi returned to his hometown. “After a while, she kept calling and texting to try to mend the relationship. It took a year for Hue and I to decide to get back together, but life was only peaceful for a few days, then Hue got pregnant so I tried to hold back. The couple's finances were still difficult, so Hue returned to her hometown to give birth. In mid-2012, I returned to my hometown to take my wife and children to Lam Dong. After only 3 months, the couple had conflicts again. She left the child with me, packed her clothes and left,” Phi said.

Phi had to work and take care of the child alone, so when the child was 2 years old, Hue texted asking to reunite. He was very angry but loved his child, so Phi agreed to let his wife go home. During Tet 2014, Hue took the child to her parents' house and left him, going to Dong Nai alone. Phi suppressed his anger and went back to his hometown to pick up the child to live with him. "After a while, Hue asked to rekindle the relationship. This time, I couldn't ignore it anymore, so I didn't agree and asked for a divorce. Hue agreed. She took the child away but kept texting to "terrorize" me. Once, Hue texted me to give the child back to me and come and get it. I was angry with my wife's attitude, so I slapped her a few times and then took the child home. She asked the police to intervene so she could raise the child. Thinking that the child was still young and it would be better to stay with the mother, I agreed to let her take the child home but she had to write a commitment to take good care of the child," Phi continued.

The medicine that "kills" an already broken marriage

After winning custody of the child and agreeing to “go their separate ways”, Hue took the child back to her mother-in-law’s house. Her mother-in-law was old and had a sore leg, but Hue not only did not help with the housework but also scolded her. Once, during an argument, the rude daughter-in-law even wanted to “throw a rock down her mother-in-law’s throat”. When neighbors gave their opinions, Hue cursed. Phi heard about the incident, so at the end of March 2015, Phi took a bus back to his hometown to settle the family matter once and for all.

On the morning of March 26, 2015, after the conversation, Phi and his wife agreed to divorce. At the end of the conversation, Phan Truong Phi went to his sister's house to visit and asked her to buy some intestines to drink with his brothers on the occasion of returning home after a long time. Having personally prepared the intestines, Phi went upstairs to get the spices. When he went down to the kitchen, he saw Hue coming out with an unusual attitude. Suspicious, Phi turned on the flashlight to examine the intestines pot and saw a layer of brown powder on the surface. When he asked his wife, Hue said she didn't put anything in it, "If you don't believe me, let me eat it for you, I'm dying too", Hue said.

Sensing something was wrong, Phi wanted to report to the police, but Hue held him back and confessed, “I was foolish.” Despite his wife’s pleas, Phi went to report to the police. When he returned, Hue was no longer at home. Three days later, Hue returned, was taken to her husband’s house by relatives to apologize and persuaded to turn herself in to the investigation agency. The investigation agency seized two packages of rat poison from Phi’s house, one of which had been opened and used.

At the investigation agency as well as at the first instance and high-level appeal trials, Hue stated that during their time together, the couple often had conflicts, and that she was repeatedly beaten and abused by her husband. Hue did not admit that she had put rat poison in the food pot to poison her husband. However, at times, Hue claimed that she had "accidentally" let the rat poison fall into the food pot or that she did not intend to poison her husband but to commit suicide.

At the high-level appeals court held at the end of June, Hue insisted on her innocence, accusing the investigator of prompting and forcing her to confess, and requested that the case file be returned and reinvestigated. “If a reinvestigation results in a higher penalty, I will accept it. I am innocent,” Hue told the court.

Based on the self-confessions, the statements of the investigator with the participation of Hue's defense attorney, based on the evidence collected during the investigation..., the High People's Court's panel of judges determined that prosecuting Dau Thi Hue for murder was the right person and the right crime. The fact that Phi did not die was beyond Hue's will, but the act was enough to constitute a crime. The 4-year prison sentence imposed by the first instance court was appropriate, there was no basis to return the case file for re-investigation.

The woman’s cruelty did not cause fatal consequences, but it did put an end to an already turbulent marriage. Four years, hopefully enough time for Hue to look back and change herself…
