(Baonghean.vn) - Many households in the mountainous commune of Phuc Son, Anh Son district, have long been in a state of "living with the forest", when the entire residential land area where they have built houses and lived stably for a long time has been completely covered by the Forestry Land Use Rights Certificate.

Forest land covered by residential land

Phuc Son is a commune with a large area, large land area, and fragmented terrain.Anh Son district. From National Highway 7A, the distance from the commune center to Bai Da and Bai Lim villages is about 9km and to Cao Veu village is about 20km. Due to the large area, land management in this area still faces many difficulties. In particular, when issuing new Land Use Right Certificates to people, the local authorities found that many households had their residential land area covered by Forestry Land Use Right Certificates (issued in 2012-2013).

Mr. Dang Dinh Nien, residing in Kim Tien village (Phuc Son commune) said: His family is originally from hamlet 4, Phuc Son commune. In 1989, his family went to reclaim new economic land in Kim Tien village, and in 1991, the whole family moved here to live. In 2013, a survey team came to measure, after that, Mr. Nien's family was granted a Certificate of land use rights with an area of ​​28,000m2, the purpose of use was production forest land without any square meter of residential land. Meanwhile, in reality, he and his wife divided the land for their family of 4 children to build a house and live permanently on an area of ​​about 5,000m2. Currently, because they are not granted residential land, their family is facing many difficulties in borrowing capital for production.

Mr. Nguyen Ngoc Phung - Head of Kim Tien village said: The whole village has 180 households, currently there are 26 households with residential land covering forestry land. Of these, 5 households have been surveyed with official cadastral maps, while 21 households have not been surveyed with official cadastral maps. Mr. Phung also could not explain the reason for this inadequacy.

Not only Kim Tien village, currently in Phuc Son commune, in village 8 there are 39 households that also have residential land covering forestry land but it has not been surveyed. Or there are 36 households in Veu 4 village that have residential land covering forestry land, although it has been surveyed but it has not been separated to issue a Certificate of residential land use rights.

No measurement funds yet

According to the data compiled by the People's Committee of Phuc Son Commune, currently there are 73 households in the commune that have filed for the issuance of Certificates of Land Use Rights. These households have built houses since 1989, but when measuring and issuing the Certificates of Forestry Land, they did not separate the residential land from the forestry land.

In addition, there are 60 households in the category of newly issued Land Use Right Certificates that have not been surveyed. Of these, 21 households in Kim Tien village and 39 households in village 8 have built houses since 1989 and have not been surveyed on the official cadastral map, while the land plot of the family that has built the house is shown on the forestry map 163 surveyed in 1997.

Mr. Nguyen Van Trang - Chairman of the People's Committee of Phuc Son Commune said: Currently, the commune has also reported this situation to the superiors for consideration and handling. The People's Committee of the commune itself also recommends that for households whose residential land covers forestry land but has been measured on a regular cadastral map, it is necessary to measure the area of ​​the house to separate the residential land area from the forestry land. After that, issue a Certificate of residential land use rights to the people and adjust the changes in the residential area on the forestry land, or issue a new Certificate of land use rights.

For the land area where houses have been built on forestry land but have not been officially surveyed, it is necessary to promptly measure and separate the residential land area to issue Land Use Right Certificates to the people and adjust the changes in the housing area on forestry land.

For households using unmapped forestry land, mapping will be conducted to have a basis for preparing documents to issue Forestry Land Use Right Certificates to the people.

Mr. Trang also pointed out the current situation, because in the past, the forestry land area of ​​many households was measured manually, so there were errors. Currently, many families have the need to donate, give or transfer, but when measuring in the field, it is not consistent with the shape and area that has been granted. In fact, those shortcomings have been proposed by the locality to the superiors but have not been implemented. Meanwhile, the cases of being granted forest land over residential land are mostly in remote villages and hamlets, such as Bai Da, Bai Lim, Veu 1 village; Veu 2 village; Veu 3 village; Veu 4 village... people's lives are still difficult, people do not have the funds to measure themselves. Therefore, the locality has also recommended that the superiors pay attention to measuring and carrying out procedures to grant Certificates of Land Use Rights to people according to regulations...

Mr. Bui Cong An - Head of the Department of Natural Resources and Environment of Anh Son district said: The households that were granted forest land as residential land in Phuc Son commune have not been granted a Certificate of Land Use Rights before. Previously, this area was not measured and mapped 299. The district has also received a summary document and request from Phuc Son commune. However, up to now, there has been no funding to measure and separate the residential land area from the forestry land, so it has not been implemented...
