On April 27, the Investigation Police Department of Nam Dan District Police received a complaint from Ms. HTH (born in 1994, residing in Nam Dan District) about Phan Van Tai (born in 1994, residing in Nam Dan District) forcing her to have sex. According to Ms. H's statement, she and Tai met when they were both university students. After a while, the two developed feelings for each other and Ms. H also gave her virginity to the man she loved.

During the times when the two were "intimate", Tai used his phone to record images in many different positions as souvenirs. However, after graduating, Ms. H got a job, but Tai still had to go to school. Conflicts often arose between the two, so Ms. H broke up with Tai in March 2016. Despite this, Tai still tried to hold on and repeatedly asked Ms. H to get back together, but she did not agree.

Tai texted and used sensitive pictures of the two of them when they were still in love, threatening to post them on the internet or send them to Ms. H’s lover and her family to force her to have sex. Because of fear, Ms. H repeatedly satisfied Tai’s wishes.

Upon receiving the report, the police began an investigation. On May 1, the police received information that Tai called Ms. H and asked her to go to a motel in the area so that he could give her Facebook password to delete those "hot" photos. Detectives raided the motel room and caught Tai in the act of raping Ms. H. There, the police confiscated the cell phone containing many sensitive photos that Tai used to "blackmail" Ms. H. On May 6, the Nam Dan District Police (Nghe An) announced that they had initiated a case, prosecuted the accused and temporarily detained Phan Van Tai to investigate the act of rape.

Article 135 of the Penal Code stipulates the crime of extortion. Accordingly, anyone who threatens to use force or uses other means to intimidate another person in order to appropriate property shall be sentenced to imprisonment from one to five years. Depending on the severity, the offender may be sentenced to imprisonment from up to twenty years, in addition to being fined from ten million to one hundred million dong, and may have part or all of their property confiscated.

Also in April 2016, Quynh Luu District Police received a complaint from Tran Thi H., residing in Quy Hop District (Nghe An) about her ex-lover threatening to release nude photos for the purpose of blackmail. According to the victim, the story began in December 2015, when Nguyen Khanh Duong (born in 1990, residing in Hamlet 9, Quynh Thuan Commune, Quynh Luu District) met Tran Thi H., residing in Quy Hop District (Nghe An) through the social network Zalo. Although he only worked as a construction worker and was married, Duong lied to her that he was still single and currently working as an electricity officer in Vinh City. After many days of texting back and forth, a love affair developed between the two.

After seeing that the situation was “ripe”, Duong made an appointment to meet Ms. H. in Quy Hop district at the end of March 2016. Here, Duong secretly used his phone to take “hot” pictures of the two of them having sex without Ms. H. knowing. With the “treasure” in hand, on April 25, Duong immediately called Ms. H. and asked her to give him 10 million VND or else the “hot” pictures would be posted on social networks. Too scared, Ms. H. borrowed 10 million VND to go to Cau Giat town (Quynh Luu district) to give that amount of money to Duong as he had promised Ms. H. before.

While eagerly receiving money from Ms. H, the police force of Quynh Luu district caught Nguyen Khanh Duong in the act. On the morning of May 9, the police of Quynh Luu district, Nghe An issued a decision to prosecute and detain Nguyen Khanh Duong for the crime of Extortion.

Lessons for young people

Looking back at the cases of sex clip distribution that were exposed by the police, many of the main characters had their lives ruined by their "sleeping partners" because of "dirty films". In less than a month, there have been consecutive cases of posting "hot" photos and sex clips online that have resulted in prosecution.

A person who commits a crime, whether he knows in advance or not that his behavior is a crime, the legal consequences of that behavior are still the judgments of the law.

These offensive acts will face the crime of "Disseminating obscene cultural products" - stipulated in Article 253 of the Penal Code. The highest penalty for this crime is up to 15 years in prison. In addition, those who threaten to release nude photos to blackmail or extort will face the crimes of "extortion" and "rape".

Regardless of the cause or incident, the above offensive images have spread rapidly, causing no small impact on those involved and public opinion.

The act of using nude photos to blackmail others can be prosecuted for rape under Article 113 of the 1999 Penal Code. Accordingly, anyone who uses any means to force a person dependent on them or a person in a desperate situation to have sexual intercourse will be sentenced to between 6 months and 5 years in prison. Depending on the severity of the act, the offender can be sentenced to between 3 and 10 years in prison. Raping a minor from 16 to under 18 years of age is punishable by between 2 and 7 years in prison. The offender can also be banned from holding a position, practicing a profession or doing certain jobs from one to five years.

The victims are all people who had an intimate relationship with the person who posted the nude photos, but due to carelessness or not foreseeing the consequences, they let the other person film and take pictures of sensitive moments. And sometimes it becomes a dangerous “weapon” serving an impure and somewhat base motive.

Perhaps no one forbids and the law also does not forbid in private relationships between men and women from filming or recording moments together. However, it is necessary to have a sober view and know how to preserve beautiful images instead of sensitive images.

The harsh sentence of the law will be a valuable lesson for those guys who disregard the honor and dignity of others. But behind this 'incident', not only the person who posted the photos had to pay a price, but even the victim had difficulty facing public opinion.
