(Baonghean.vn) - The Provincial Party Standing Committee has just issued Regulation No. 18-QD/TU, dated November 1, 2022 on "Decentralization of cadre management and appointment and introduction of candidates" to specify Regulation No. 80-QD/TW, dated August 18, 2022 of the Politburo, replacing Regulation No. 3703-QD/TU, dated July 9, 2020.

Leaders of the Provincial Party Committee's Organizing Committee chaired an online workshop to collect opinions on the draft Regulations on cadre rotation.

The Regulation consists of 7 chapters and 35 articles, which stipulate the purpose, requirements, principles, contents, responsibilities, and authority in cadre management and the principles, responsibilities, authority, standards, conditions, procedures, and processes for appointment, reappointment, nomination, re-election, appointment, transfer, and secondment of cadres. This Regulation applies to Party committees, Party organizations, agencies, units, and cadres, civil servants, and public employees in the province's political system.

Regulation No. 18-QD/TU clearly states 8 contents in cadre management as well as management and decision-making responsibilities for cadres. Accordingly, the Standing Committee of the Provincial Party Committee manages and directly decides on a number of contents in cadre work, and at the same time assigns and decentralizes to Party committees at all levels, Party organizations, and collective leaders of agencies and units to decide on a number of stages and contents of cadre work for a number of leadership positions under the management of the Standing Committee of the Provincial Party Committee and other cadre positions; authorizes the Standing Committee of the Provincial Party Committee to decide on a number of stages and contents in cadre work.

Compared with Regulation 3703-QD/TU, this Regulation adds more positions under the management of the Provincial Party Committee Standing Committee, including: Head of the National Assembly Delegation, full-time National Assembly Delegation and Secretary of the Provincial Party Committee Secretary according to the regulations of the Central Committee. At the same time, inheriting the decentralization to Party committees and Party organizations to manage the positions: Member of the Standing Committee of the Party Committee, Vice Chairman of the People's Council, Vice Chairman of the People's Committee of districts, cities and towns; On the other hand, further strengthening the decentralization of management for positions such as: Standing Member of the Provincial Fatherland Front Committee and Member of the Standing Committee of provincial socio-political organizations for subordinate Party committees and Party organizations.

The regulation also decentralizes management for cadres who have left their positions or retired, thereby authorizing the Standing Committee of the Provincial Party Committee to review and give opinions on the following positions: Former member of the Standing Committee of the Provincial Party Committee; former Chairman of the Provincial Fatherland Front, former Vice Chairman of the Provincial People's Council, former Vice Chairman of the Provincial People's Committee, former Head and Deputy Head of the full-time Provincial National Assembly Delegation; other positions will be given opinions by the Party Delegation, Party Executive Committee, Party Committee, agency, unit and the Provincial Party Committee's Organization Board depending on the position before leaving office or retiring.

Regarding the appointment and introduction of candidates: Cadres and Party members who are under inspection for signs of violations, under consideration, disciplined, recommended to be handled for violations according to inspection conclusions, handling of denunciations and under investigation shall not be planned, nominated, appointed, or reappointed when the appointment, transfer, rotation, secondment, training, examination for promotion, rank, rank, salary increase, title conferment, commendation, resignation or termination of employment have come. Cadres introduced from the local human resources must be planned for the appointed position or planned for an equivalent position or higher; must have held the current position or equivalent position for at least 02 years (24 months). Special cases shall be considered and decided by competent authorities; cadres proposed for appointment to a leadership or management position (higher) for the first time must be old enough to work for a full term; Disciplined cadres shall not be assigned, appointed, or recommended for candidacy to a position higher than the position they were disciplined for within the following period (from the date of signing the disciplinary decision): 12 months for the disciplinary form of Reprimand; 30 months for the disciplinary form of Warning; 60 months for the disciplinary form of Removal from office.

The regulation also clearly states that the process of introducing personnel from local human resources is carried out in 5 steps, the participants and the specific selection principles of each step. In which, in step 2, if no one receives 30% or more of the votes, the next steps will not be continued and the competent authority will be reported for consideration and direction; in step 3, if the recommended personnel are different from step 2, the collective leadership will meet, discuss, analyze carefully, consider many aspects, consider, and decide to select personnel to introduce in the next step (by secret ballot) according to their authority and take responsibility for their decisions.

The selected person must have at least 2/3 of the total number of votes of the leadership team as prescribed. In case no one receives at least 2/3 of the votes, the next steps will not be carried out and the competent authority will be reported for consideration and direction.

The regulation also states that the term of office of a chief of staff shall not exceed 2 consecutive terms (8 years or more in the same locality, agency or unit) and shall be carried out in accordance with Party regulations and specialized laws.

Regarding reappointment and re-election: The regulation clearly states that at least 90 days before the end of the appointment term, the competent authority must notify the cadre to prepare the re-appointment procedures according to regulations. After being appointed or nominated for election for one of the following reasons: poor health; diminished prestige; failure to complete tasks; violation of party discipline, state laws, etc., the competent authority shall decide on replacement, dismissal, dismissal, resignation, or removal from office, without waiting for the end of the term of office or the end of the working term.

The reappointment of leaders and managers with 2 years or more of work remaining must follow the reappointment process according to regulations; in cases where there are less than 2 years of work remaining, the head and the leadership team shall discuss and consider. If the cadre is still healthy, prestigious, and meets the requirements of the task, vote (by secret ballot), report to the competent authority for consideration and decision to extend the term of office until retirement age without having to follow the reappointment process. Cadres who are not reappointed or recommended for re-election shall be considered and decided by the competent authority to arrange other jobs according to the principle that they cannot be assigned to equivalent or higher positions.

At the same time, to specify the Conclusion Notice No. 20-TB/TW, dated September 8, 2022 of the Politburo "on the policy of work arrangement for cadres under the management of the Politburo and the Secretariat after being disciplined" and Instruction No. 21-HD/BTCTW, dated September 20, 2022 of the Central Organizing Committee on instructions for implementing Point 3, Notice No. 20-TB/TW, dated September 8, 2022 of the Politburo, Regulation 18 of the Provincial Party Committee Standing Committee also devotes a chapter (Chapter IV) to orient the arrangement and implementation process for cadres under the management of the Provincial Party Committee Standing Committee after being disciplined with a warning or reprimand but with limited capacity and reduced prestige.

This regulation takes effect from the date of issuance and replaces Regulation No. 3703-QD/TU, dated July 9, 2020 of the Provincial Party Standing Committee. Party committees, party organizations, agencies and units shall base on this regulation to specify the decentralization, authority, responsibility, and content of cadre management; the process and procedures for appointing, recommending cadres for election, reappointment, recommendation for re-election, transfer and secondment of cadres under decentralized management.
