The Provincial Citizen Reception Committee responded to petitions from citizens of Dien Loi commune, Dien Chau district regarding cemetery and crematorium planning.

On the morning of October 15, 2024, at the Citizen Reception Office of Nghe An province, comrade Thai Minh Tuan - Deputy Chief of the Provincial People's Committee Office - Head of the Provincial Citizen Reception Committee, chaired the reception of citizens of Dien Loi commune, Dien Chau district who came to make recommendations and feedback according to the provisions of Article 30 of the Law on Citizen Reception 2013. Attending the citizen reception were representatives of relevant departments and branches and the Chairman of the People's Committee of Dien Chau district.

Representatives of citizens of Dien Loi commune, Dien Chau district participated in presenting petitions and reflections at the citizen reception, including: Mr. Hoang Tien Sy, Ms. Nguyen Thi Oanh, Ms. Tran Thi Sung (residing in hamlet 3); Mr. Dang Ban, Mr. Nguyen Xuan Son, Mr. Nguyen Duc Bay (residing in hamlet 6); Mr. Le Quang Hoa (residing in hamlet 5); Ms. Le Thi Thuy (residing in hamlet 2).

After listening to the citizen's presentation, comrade Thai Minh Tuan - Deputy Chief of Office of the Provincial People's Committee, Head of the Provincial Citizen Reception Committee, chaired the citizen reception session and concluded as follows:

1. For contents related to some violations of the Company Thien Hoang Equipment Joint Stock Company and Hoang Phuc Company Limited

1.1. Regarding the case of administrative violations in the land sector of Thien Hoang Equipment Joint Stock Company: The People's Committee of Dien Chau district has drawn up a record of administrative violations on October 2, 2024 and has submitted Document No. 245/TTR-UBND dated October 2, 2024 to the Chairman of the Provincial People's Committee to sanction administrative violations according to authority (on October 15, 2024, the Chairman of the People's Committee of Nghe An province issued Decision No. 163/QD-UBND to sanction administrative violations against Thien Hoang Equipment Joint Stock Company, for violating the law on encroachment of production forest land in rural areas, Dien Loi commune, Dien Chau district). Thien Hoang Equipment Joint Stock Company is responsible for paying all fines and taking remedial measures; The People's Committee of Dien Chau district is responsible for organizing the strict implementation of the Decision on sanctioning by the Chairman of the Provincial People's Committee.

1.2. Regarding the violation of Hoang Phuc Company Limited, currently the competent authorities and the People's Committee of Dien Chau district and the People's Committee of Dien Loi commune have inspected and established the violation records (determining the area and volume of land exploited by Hoang Phuc Company Limited in violation as the basis for establishing the Administrative Violation Record) to submit to the competent authority to handle the violation in accordance with the law.

The Provincial Citizen Reception Committee requests the People's Committee of Dien Chau district to: Fully inform the people about the handling by authorities at all levels of administrative violations of Thien Hoang Equipment Joint Stock Company and Hoang Phuc Company Limited according to the provisions of law.

1.3. Regarding the contents of citizens' reflections and recommendations on the slow progress of the construction of the road to the mine area, many construction items are not in accordance with the approved design; the planting of trees on both sides of the road has not been seriously implemented, only after people have made many recommendations, but the number and quality of trees are not guaranteed; During the process of exploiting and transporting soil, enterprises lack measures to ensure environmental hygiene (limit dust), affecting the normal life of people in the area, especially for households living near the mine and on both sides of the transport road.

The Provincial Citizen Reception Committee requested the People's Committee of Dien Chau district to respond to citizens in writing. The results of implementation will be reported to the Provincial People's Committee before November 30, 2024.

2. For the contentreflectlight, ants recommendations regarding cemetery planning,basefireburied in Dien Loi commune, Dien Chau district:

2.1. The citizen's reflection that "The cemetery and crematorium project in Dien Loi commune, Dien Chau district" violates construction and environmental standards is unfounded because:

- Pursuant to Decision No. 2485/QD-UBND dated August 11, 2023 of the Provincial People's Committee on approving the Construction Planning of Dien Chau district, Nghe An province for the period 2021 - 2030, with a vision to 2050, the People's Committee of Dien Chau district is organizing the implementation of "Adjustment of the General Planning of Dien Loi commune".

Currently, the Project "Adjusting the general construction planning of Dien Loi commune" which includes the content of determining the boundaries and land use area of ​​each functional subdivision (including the crematorium subdivision and cemetery subdivision) organized by the People's Committee of Dien Loi commune to hire a consulting unit to establish, is "Organizing to collect opinions of the community on the Planning Project" according to the provisions of Article 17 of the Construction Law 2014. Therefore, citizens of Dien Loi commune have the right to send their opinions related to the Planning Project to the People's Committee of Dien Loi commune for synthesis and submission to competent authorities for consideration and decision in the next steps.

- After the Planning Project is approved and announced according to the provisions of Clause 1, Article 40 of the 2014 Construction Law, the competent authority will carry out the construction procedures and approve the "Cemetery and crematorium project in Dien Loi commune, Dien Chau district" for implementation.

2.2. Regarding the contents that citizens request competent authorities to provide and fully explain the legal basis, scientific basis, practical basis..., specific steps to be taken in cemetery planning, the scope of cemetery services and request not to implement the cemetery crematorium project in Dien Loi commune, Dien Chau district. Some of the contents that citizens petitioned were answered by the Chairman of Dien Chau District People's Committee at the citizen reception on October 10, 2024; Dien Chau District People's Committee issued Document No. 287/TB-UBND dated October 14, 2024 to inform and respond, but citizens continue to petition.

Based on the authority to establish, approve and promulgate the planning "Adjustment of the general planning of Dien Loi commune" according to the provisions of the law on construction, the Provincial Citizen Reception Committee requests the People's Committee of Dien Chau district to continue to review, provide full information and respond to citizens according to the provisions of the Law on Access to Information 2016, Circular 05/2021/TT-TTCP dated October 1, 2021 of the Government Inspectorate and other relevant legal provisions. The implementation results will be reported to the Provincial People's Committee before November 30, 2024.

3. Regarding other reflections and recommendations (related to the Project of exploiting 2 new mines in Dien Loi commune; statements of district leaders; inappropriate propaganda information of the TV station; the administrative inspection of vehicles of Dien Loi commune residents by functional forces on October 15, 2024...):

The Citizen Reception Committee requests that citizens submit applications (with relevant records and documents) to competent authorities for consideration, resolution, and response according to regulations.
