Provincial Social Insurance imposes administrative fines and collects social insurance money from companies that 'forget' to pay for employees

(Baonghean.vn) - An electrical system installation company located in Vinh city has just been administratively fined by the Nghe An Provincial Social Insurance for not paying social insurance, health insurance, and unemployment insurance for enough people who are required to participate in social insurance, health insurance, and unemployment insurance.

That is Quy Diep Trading and Service Company Limited, located at 47 Le Khoi Street, Quang Trung Ward, Vinh City; main business lines are electrical system installation, wholesale of machinery, equipment and other spare parts.

The decision on administrative penalty issued by the provincial Social Insurance clearly states:The Company committed an administrative violation in paying social insurance, health insurance, and unemployment insurance, which is: Paying social insurance, health insurance, and unemployment insurance for an insufficient number of people required to participate in social insurance, health insurance, and unemployment insurance for 01 employee, Mr. Le Duy Quy, born on August 19, 1963.

It is known that Mr. Le Duy Quy has worked at Quy Diep Trading and Service Company Limited since January 1, 2017 but has not been paid social insurance, health insurance, and unemployment insurance by the company as prescribed.

The above behavior violated Point c, Clause 2, Article 26 of Decree No. 95/2013/ND-CP dated August 22, 2013 of the Government regulating administrative sanctions in the field of labor, social insurance and sending Vietnamese people to work abroad under contracts; violated Clause 2, Article 57 of Decree No. 176/2013/ND-CP dated November 14, 2013 of the Government regulating administrative sanctions in the field of health.

For the above violation, in addition to having to pay the administrative penalty of VND 3,797,000 to the State Budget revenue account, Quy Diep Trading and Service Company Limited must also pay the unpaid compulsory social insurance and unemployment insurance; the interest on the unpaid compulsory social insurance and unemployment insurance at the prescribed interest rate and must pay the payable amount and the interest on the unpaid amount to the Health Insurance Fund's specialized collection account for the act of not paying social insurance, health insurance and unemployment insurance to Mr. Le Duy Quy according to regulations.

This is a drastic move by the provincial Social Insurance sector against violations of workers' rights regarding social insurance, health insurance, and unemployment insurance.
