Ministry of Public Security officially receives Mobifone's purchase of AVG documents

The Department of Police Investigation of Economic Crimes and Corruption (C46) - General Department of Police, Ministry of Public Security is receiving the entire case file of Mobifone's purchase of AVG from the Government Inspectorate to review, investigate and clarify signs of law violations.

On the morning of April 24, sources from the Government Inspectorate and the Ministry of Public Security confirmed that the Department of Investigation Police on Economic Crimes and Corruption (C46) is receiving all documents of the Mobifone purchase of AVG from the Government Inspectorate.

“C46 started receiving documents at the Government Inspectorate yesterday (April 23). However, there are quite a lot of documents and files, so it is unclear how long it will take to complete,” the source said.

In the previously made public inspection conclusion, the Government Inspectorate recommended that the Prime Minister assign the competent investigation agency of the Ministry of Public Security to receive all inspection records and documents of the Mobifone Telecommunications Corporation project to purchase 95% of AVG shares for review, investigation, and handling of the right people, the right violations, and the law. The inspection conclusion was also sent to the Central Inspection Committee for review and handling according to its authority for officials under the management of the Politburo and the Central Secretariat related to the above shortcomings and violations.

The inspection conclusion affirmed that Mobifone's violations, violations of regulations, and lack of responsibility have led to the risk of serious damage to the State's capital at Mobifone of about VND 7,006 billion, of which the damage due to purchasing AVG's payable debt is VND 1,134 billion.

The implementation of the project investment has directly negatively affected telecommunications business activities, causing a significant decrease in business efficiency since 2016 and many subsequent years, in which financial operating profit in 2016 decreased compared to 2015 by VND 321.7 billion; accumulated loss up to December 31, 2017 was VND 1,982.7 billion; at the same time negatively affecting Mobifone's equitization.

The Ministry of Information and Communications, with its functions and duties as the agency representing the owner and managing the state on information and communications, has been irresponsible in appraising the project; Decision No. 236/2015 approving the investment project does not ensure a legal basis, violates the provisions of the law, causing serious damage to state capital, and needs to be reviewed and revoked.

The Prime Minister has agreed with the conclusion of the Government Inspectorate on the Mobifone purchase of 95% of AVG.

On March 8, the Central Party Office issued a notice stating that the Secretariat had a meeting chaired by General Secretary Nguyen Phu Trong to listen to the Government Inspectorate Party Committee report on the results of the inspection of the Mobifone project to buy 95% of AVG shares. The Secretariat said that this was a very serious, complicated, sensitive case, of special concern to public opinion.

The Secretariat requested that responsible agencies promptly review and handle the case to ensure objectivity and accuracy in accordance with Party regulations and State laws, with a resolute and strict spirit, clarifying and handling the case to the right person, right violation, right law, and recovering lost State assets.
