Appointment of 53 leaders in violation of regulations

Through inspection, the Inspectorate of the Ministry of Home Affairs pointed out that Ninh Thuan province appointed 53 cases to leadership and management positions that did not fully meet regulations.

The Inspectorate of the Ministry of Home Affairs has just announced the conclusion of the inspection of the management of payroll, recruitment, appointment, number of deputies... in state administrative agencies of the People's Committee of Ninh Thuan province, period 2014-2017.

To clarify issues related to the appointment, re-appointment, and extension of tenure for leading and managerial civil servants, the Inspectorate of the Ministry of Home Affairs directly inspected 192 files. The inspection results showed that the civil servants appointed and re-appointed basically met the conditions and standards of the position. The appointment process was also basically complete.

However, there are 53 cases of appointment to leadership and management positions that do not fully meet one or several standards regarding political theory qualifications, state management certificates, foreign language certificates, and computer science certificates.

Some appointment procedures under the authority of heads of agencies and units have not been reflected in writing in the appointment records. The time for carrying out procedures, issuing decisions on reappointment and extension of tenure in many cases does not ensure the time as prescribed.

From 2014 to 2016, the Ninh Thuan Provincial People's Committee accepted 13 civil servants without taking the exam and considered 4 commune-level officials and civil servants to become civil servants from the district level and above according to its authority. However, the implementation process still had some limitations, such as the examination council in 2014 and 2015 did not ensure the composition according to regulations, and some civil servant files did not have state management certificates for the specialist level.

At the time of inspection, agencies and units under the People's Committee of Ninh Thuan province were still using 131 labor contracts to do professional work in state administrative agencies.

From the above shortcomings, the Inspectorate of the Ministry of Home Affairs recommends that the Chairman of the People's Committee of Ninh Thuan province find a solution to completely resolve the issue of 131 contract workers doing professional and technical work in agencies and administrative units. Stop signing and using contract workers doing professional work in agencies and units.

Ninh Thuan province must review the conditions and standards for civil servants holding leadership and management positions. Thereby promptly detecting cases that do not meet the requirements in order to have a plan to send them for training and development.

The Inspectorate of the Ministry of Home Affairs also recommended that Ninh Thuan province issue regulations on the deadline for civil servants to complete the missing conditions and standards. At the same time, dismiss those who do not meet the conditions and standards according to the appointed position.

According to the recommendation of the Inspectorate of the Ministry of Home Affairs, Ninh Thuan province is also not allowed to reappoint cases that do not fully meet the conditions and standards of the position.

Through the inspection, the Inspectorate of the Ministry of Home Affairs recommended that the Chairman of the People's Committee of Ninh Thuan province review and clarify the responsibilities of relevant units, organizations and individuals for the above limitations and shortcomings in order to have appropriate handling measures.
