(Baonghean.vn) - The Ministry of Home Affairs has just issued a document responding to the petition of Nghe An province at the Government Conference with localities.

Accordingly, the Ministry of Home Affairs received a petition from Nghe An province sent by the Government Office under Document No. 411/VPCP-QHDP dated January 20, 2023 on handling petitions from localities at the Government's online conference with localities on January 3, 2023, with the following content:
"We respectfully request that the Government and the Prime Minister continue to promote decentralization and delegation of power to localities to carry out tasks, especially in the investment sector, to create proactive flexibility in implementation."
The Ministry of Home Affairs responded as follows:
Implementing the Resolution of the 13th National Party Congress, the Government issued Resolution No. 50/NQ-CP dated May 20, 2021 on the Action Program to implement the Resolution of the 13th National Party Congress, which sets out the task of promoting and perfecting the mechanism of decentralization, delegation of power, and authorization, ensuring unified management, effectiveness and efficiency of operations; at the same time promoting proactiveness and creativity; enhancing the sense of responsibility of each level and each sector associated with the mechanism of power control. On that basis, the Ministry of Home Affairs advised and submitted to the Government to issue Resolution No. 04/NQ-CP dated January 10, 2022 on promoting decentralization and delegation of power in state management (hereinafter referred to as Resolution No. 04/NQ-CP).
Resolution No. 04/NQ-CP clearly defined the objectives: To promote and perfect the decentralization and delegation mechanism to clearly define the tasks and powers, competences and responsibilities between the Government and ministries and branches; between the Government, the Prime Minister, ministries and branches and local authorities in association with perfecting the legal system in a complete, synchronous, unified, timely, feasible, stable, public and transparent manner... At the same time, to set out tasks and solutions to perfect the regulations on decentralization of state management between the Government, the Prime Minister, ministries, branches and local authorities by branches and fields; to perfect the regulations on decentralization of state management between the Government, the Prime Minister, ministries and ministerial-level agencies and local authorities by branches and fields... and assign ministries and ministerial-level agencies to develop plans to organize and implement. To carry out the assigned tasks in Resolution No. 04/NQ-CP, ministries and ministerial-level agencies have advised competent authorities to promulgate new, amend, supplement and promulgate new, amend and supplement according to their authority 09 Laws.[1]; 06 Resolutions of the National Assembly on piloting a number of specific policy mechanisms of localities[2]; 01 Resolution of the National Assembly on the special mechanism of Buon Ma Thuot city, Dak Lak province; 06 Decrees of the Government[3]; 04 Decisions of the Prime Minister[4]; 05 Circulars of Ministers and Heads of ministerial-level agencies[5].
In addition, every month, the Government holds a meeting on legal policy development to perfect the institution and urge ministries and branches to implement decentralization, delegation of power, and improve the effectiveness and efficiency of state management by sector and field; The Prime Minister issued Decision 435/QD-TTg dated April 24, 2023 assigning members of the Government to preside over, urge, and work with localities on the situation of production, business, public investment, infrastructure construction, and import and export in the area to grasp the situation of production and business in 63 localities, thereby identifying limitations, difficulties, and obstacles to perfect the institution, promote decentralization of state management in accordance with the situation and characteristics of the localities; at the same time, include it in the Government's legal document development plan and report to competent authorities to include it in the legal document development program to implement decentralization and delegation of power.
