Ministry of Finance responds to Nghe An voters' petition on management and use of appraisal fees for planning projects
(Baonghean.vn) - The Ministry of Finance has received a petition from voters of Nghe An province, sent by the People's Petition Committee, regarding the management and use of appraisal fees for planning projects.
The content is as follows: Currently, the collection of fees for appraisal of planning projects is temporarily implemented according to Circular No. 20/2014/TT-BXD dated December 31, 2012 of the Ministry of Construction guiding the determination and management of construction and urban planning costs. However, there are no specific instructions on how to manage and use this fee.
Voters recommend that the Ministry of Finance soon issue a Circular regulating the collection rates, collection, payment, management and use of fees for appraisal of planning projects, creating favorable conditions for localities in the process of implementing the collection, payment, management and use of this type of fee.
Reply:
- At point 3.2, section II, Part A. The list of fees and charges issued with the Law on Fees and Charges stipulates that "fees for appraisal of planning projects" are under the regulatory authority of the Ministry of Finance.
- Clause 4, Article 20 of the Law on Fees and Charges stipulates the responsibility of the Ministries: "to recommend to the Government or the Ministry of Finance on the collection, payment, exemption, reduction, management and use of each fee and charge in the sector and field of management".

- Clause 3, Article 6, Decree No. 120/2016/ND-CP dated August 23, 2016 of the Government detailing and guiding the implementation of a number of articles of the Law on Fees and Charges stipulates: "3. Ministries, ministerial-level agencies, and agencies under the Government are responsible for:
a) Receive requests from fee and charge collection organizations under the management of the industry and management field, appraise and send a written request to the Ministry of Finance to issue documents regulating fee and charge collection.
b) In case the fee or charge is collected by many organizations or local agencies (without issuing separate documents for each fee or charge collection organization), the competent unit shall develop a project to submit to the Ministry for appraisal and issue a document requesting the Ministry of Finance to issue a document regulating the collection of fees and charges.

Based on the provisions of the law on fees and charges, the Ministry of Finance has issued 05 official dispatches requesting the Ministry of Construction to develop a project to collect fees for appraisal of planning projects, and send it to the Ministry of Finance to issue a document regulating fee collection in accordance with the provisions of the Law on Fees and Charges (attached with official dispatches: No. 14045/BTC-CST dated November 14)./2018; No. 9819/BTC-CST dated August 21, 2019, No. 5258/BTC-CST dated May 20, 2021, No. 7602/BTC-CST dated July 12, 2021 and No. 10961/BTC-CST dated September 23, 2021).
However, up to now, the Ministry of Construction has not proposed a plan to collect fees for appraisal of planning projects.
Therefore, we propose that voters of Nghe An province make recommendations to the Ministry of Construction so that the Ministry of Construction can synthesize and develop a fee collection project and send it to the Ministry of Finance to issue a fee collection circular according to regulations.
