Ministry of Construction issues regulations on management and use of apartment buildings

The Ministry of Construction has issued Circular No. 02/2016/TT-BXD promulgating the Regulations on management and use of apartment buildings.

Accordingly, the price of apartment building management and operation services is determined according to the provisions of Article 106 of the Housing Law, based on each apartment building and on the basis of agreement with the management and operation unit. In case the apartment building has been handed over for use but the first apartment building conference has not been held, the price of the management and operation service is decided by the investor and is clearly stated in the apartment purchase and sale or lease-purchase contract; after the apartment building conference is held, the service price is decided by the apartment building conference based on agreement with the operation unit.

The price of apartment building management and operation services is determined in Vietnamese Dong and calculated per square meter (m²) of apartment usable area or other area in the apartment building (determined by net area).

The management and operation fees for apartment buildings are paid monthly or periodically by owners and users of apartment buildings (including cases where apartments and other areas in the apartment building have been handed over but not yet used) for the management and operation unit to carry out the prescribed tasks.

The management and operation costs of an apartment building are calculated by the management and operation service price x the area (m²) used by the apartment or other non-apartment area in the apartment building.

Apartment owners are responsible for maintaining their private property and contributing to the maintenance costs of the common property of the apartment building to maintain the quality of the housing and ensure safety during use.

Maintenance of privately owned areas must not affect the privately owned areas of other owners and the common ownership and use systems and equipment of the apartment building.

This Circular takes effect from April 2, 2016.

According to Clause 1, Article 10 of the Regulations on management and use of apartment buildings, the management and operation costs of apartment buildings are for the management and operation unit to perform the following tasks: a- Control, maintain operation, regularly maintain elevator systems, water pumps, generators, automatic fire alarm systems, fire extinguishing systems, fire extinguishing equipment, backup equipment and other equipment belonging to the common ownership and common use of the apartment building and apartment complex; b- Provide security services, environmental sanitation, garbage collection, flower garden and ornamental plant care, insect extermination and other services to ensure the normal operation of the apartment building; c- Other related tasks.
