Forced Nguyen Thai Luyen and his wife to compensate 31 victims
The Civil Judgment Enforcement Agency has just forced Nguyen Thai Luyen and his wife to jointly compensate 31 victims in the fraud case that these defendants committed.
The Ho Chi Minh City Civil Judgment Enforcement Agency (HCMC Civil Judgment Enforcement Agency) has just issued a decision to enforce the judgment upon request for a number of victims in the case "Fraudulent appropriation of property”, "Money laundering" occurred at Alibaba Real Estate JSC by Nguyen Thai Luyen and his accomplices.
In addition, this department is still receiving requests for execution of judgments from victims in this case.
This decision requires the person subject to enforcement to voluntarily enforce the judgment within 10 days from the date of receipt or valid notification.
Accordingly, the HCM City Department of Civil Judgment Enforcement has forced the convicts Nguyen Thai Luyen and Vo Thi Thanh Mai to jointly compensate 31 victims who have filed a request for judgment enforcement.
The decision also clearly stated that the assets to ensure the compensation obligation of the defendant Nguyen Thai Luyen will continue to be temporarily detained, including: more than 57 billion VND; 272 gold pieces, 8 cars of various types, 2 SH motorbikes, 113 CPUs, 24 hard drives, 172 laptops, tablets, 18 mobile phones, 3 cameras, 2 memory cards, 4 camera receivers, 5 printers, wifi transmitters, projectors, 4 USBs and 1 rotor.
The amount of 400 million VND that convicts Nguyen Thai Luyen and Vo Thi Thanh Mai paid to remedy the consequences during the appeal phase for the crime of "Fraudulent appropriation of property" will be deducted from the amount that these two convicts are obliged to compensate during the sentence execution phase.
The amount of 175 million VND that 12 convicts, including Nguyen Thai Luc and Nguyen Thai Linh, paid to remedy the consequences during the appeal phase will be deducted from the amount that convicts Nguyen Thai Luyen and Vo Thi Thanh Mai are obliged to compensate during the execution phase.
From the date the judgment comes into legal effect, the THADS agency issues a decision to enforce the judgment. If the convicts Nguyen Thai Luyen and Vo Thi Thanh Mai have not yet executed the amount of money as declared by the judgment, they will have to pay additional monthly interest at the prescribed interest rate due to late execution of the judgment.
Previously, last May, the High People's Court in Ho Chi Minh City sentenced Nguyen Thai Luyen to life in prison; Vo Thi Thanh Mai to 16 years in prison for "fraudulent appropriation of property", and 7 years in prison for "money laundering". The total sentence is 23 years in prison.
Luyen's two younger brothers, Nguyen Thai Luc, received a total sentence of 22 years in prison for the two crimes above; Nguyen Thai Linh received 16 years in prison for "Fraudulent appropriation of property".
Regarding civil liability, the People's Court ordered Luyen and his wife to compensate more than VND 2,447 billion to 4,530 victims; and forced Mai to return the amount of money related to the crime of "Money Laundering" to ensure the obligation to execute the judgment.
According to the appeal judgment, taking advantage of people's lack of legal knowledge in transferring land use rights, Nguyen Thai Luyen established 22 companies under Alibaba Company, assigning family members or trusted associates to act as legal representatives.
Then, these companies bought a large amount of agricultural land in provinces and cities such as Dong Nai, Binh Thuan, Ba Ria - Vung Tau... then leveled the land, illegally built infrastructure, drew up ghost projects, and grandly promoted them as high-class residential projects to sell to customers...
